{"data":{"id":"us-ky/krs-319c.010","jurisdiction":"us-ky","citation":"KRS 319C.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Applied behavior analysis\" means the design, implementation, and evaluation of\nenvironmental modifications, using behavioral stimuli and consequences, to\nproduce socially significant impr ovement in human behavior, including the use of\ndirect observation, measurement, and functional analysis of the relationship\nbetween environment and behavior;\n(2) \"Applied behavior analysis interventions\" means interventions that are based on\nscientific re search and the direct observation and measurement of behavior and\nenvironment which utilize contextual factors, establishing operations, antecedent\nstimuli, positive reinforcement, and other consequences to help people develop new\nbehaviors, increase or de crease existing behaviors, and elicit behaviors under\nspecific environmental conditions;\n(3) \"Board\" means the Kentucky Applied Behavior Analysis Licensing Board;\n(4) \"Certification board\" means the Behavior Analyst Certification Board® or its\nsuccessor;\n(5) \"Certified\" means a practitioner who has met the certification criteria of the\ncertification board;\n(6) \"Licensed behavior analyst\" means an individual who is licensed by the board and\nmeets the requirements of KRS 319C.080;\n(7) \"Licensed assistant behavior analyst\" means an individual who:\n(a) Is licensed by the board as an assistant behavior analyst and meets the\nrequirements of KRS 319C.080; and\n(b) Works under the supervision of a certified behavior analyst;\n(8) \"Practice of applied behavior analysis \" means the application of the principles,\nmethods, and procedures of the experimental analysis of behavior and applied\nbehavior analysis, including but not limited to applications of those principles,\nmethods, and procedures to:\n(a) Design, implement, eva luate, and modify treatment programs to change the\nbehavior of individuals diagnosed with an autism spectrum disorder;\n(b) Design, implement, evaluate, and modify treatment programs to change the\nbehavior of individuals;\n(c) Design, implement, evaluate, and modify treatment programs to change the\nbehavior of groups; and\n(d) Consult with individuals and organizations.\nThe practice of applied behavior analysis shall not include diagnosis, counseling,\npsychological testing, neur opsychology, psychotherapy, cognitive therapy, sex\ntherapy, psychoanalysis, or hypnotherapy as treatment modalities;\n(9) \"Supervised experience\" means services rendered as a part of the certification\nrequirements of a behavior analyst or assistant behavior  analyst under the\nsupervision of a licensed behavior analyst;\n(10) \"Supervisee\" means a person who is not licensed but acts under the extended\nauthority and direction of a licensed behavior analyst or a licensed assistant\nbehavior analyst to provide applied behavior analysis services; and\n(11) \"Temporary licensee\" means a person who is obtaining supervised experience and\nhas obtained a temporary license.","path":["KRS Chapter 319C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31292","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"919cc46575ef787636c3b05df996cbfe9f30aafe12891a3bca7f0ad8b7cb946e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319b.150","next":"us-ky/krs-319c.020"},"notice":"GroundRules: Original legal text.
