{"data":{"id":"us-ky/krs-319c.020","jurisdiction":"us-ky","citation":"KRS 319C.020","heading":"Use of titles \"licensed behavior analyst\" or \"licensed assistant behavior","body":"analyst\" -- Performance of services by person not licensed -- Persons not\nsubject to chapter.\n(1) No person shall:\n(a) Engage in the practice of applied behavior analysis, assi st in the practice of\napplied behavior analysis, render services designated as applied behavior\nanalysis, or hold himself or herself out as a practitioner of applied behavior\nanalysis in this state, unless licensed under the provisions of this chapter; or\n(b) Use the title \"licensed behavior analyst\" or \"licensed assistant behavior\nanalyst\" or any title which is substantially the same unless licensed by the\nboard.\nAny person who violates this subsection shall be subject to the penalties contained\nin KRS 319C.990.\n(2) The provisions of this chapter shall not apply to any person who is:\n(a) Providing applied behavior analysis services to an individual in a public\nschool setting;\n(b) Implementing applied behavior analysis intervention services to an immediate\nfamily member or as a supervisee;\n(c) Licensed, certified, or registered as a health or allied health professional under\nany other provisions of the Kentucky Revised Statutes, including but not\nlimited to physicians, psychologists, social workers, nurses, counselors,\ntherapists, including occupational therapists, physical therapists and speech\ntherapists, or students within accredited training programs of these\nprofessions. Nothing in this chapter shall be construed to limit, interfere with,\nor restrict the practice, descriptions of services, or manner in which the health\nor allied health professional listed in this subsection hold themselves out to\nthe public; or\n(d) Providing applicable Medicaid waiver services.","path":["KRS Chapter 319C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31293","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"0fcb03bf3f2f76e36bba02dd6dc36d26cd84cd6411f222eb165ff8607a67dbae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319c.010","next":"us-ky/krs-319c.030"},"notice":"GroundRules: Original legal text.
