{"data":{"id":"us-ky/krs-319c.030","jurisdiction":"us-ky","citation":"KRS 319C.030","heading":"Kentucky Applied Behavior Analysis Licensing Board -- Members --","body":"Terms -- Reimbursement -- Limitation of liability.\n(1) (a) There is hereby created the Kentucky Applied Behavior Analysis Licensing\nBoard. The board shall consist of seven (7) members a ppointed by the\nGovernor.\n(b) The initial board members shall be appointed as follows:\n1. Four (4) members shall be credentialed behavior analysts nominated by\na credentialed behavior analyst practicing in the state;\n2. One (1) member shall be a psychologi st licensed in the state, the\nmajority of whose practice is related to the treatment of behavior\ndisorders, including but not limited to autism spectrum disorders. The\npsychologist member shall be nominated by a credentialed behavior\nanalyst practicing in the state; and\n3. Two (2) members shall be the parent of a child diagnosed with and\ntreated for a behavior disorder, including but not limited to an autism\nspectrum disorder, selected from the state at large.\n(c) Subsequent board members shall be appointed by the Governor as follows:\n1. Four (4) members shall be licensed behavior analysts nominated by a\nlicensed behavior analyst practicing in the state;\n2. One (1) member shall be a psychologist licensed in the state, the\nmajority of whose practice is relate d to the treatment of behavior\ndisorders, including but not limited to autism spectrum disorders. The\npsychologist member shall be nominated by a licensed behavior analyst\npracticing in the state; and\n3. Two (2) members shall be the parent of a child diagn osed with and\ntreated for a behavior` disorder, including but not limited to an autism\nspectrum disorder, selected from the state at large.\n(2) The terms of the board members shall be as follows:\n(a) The initial board members shall be appointed as determin ed by the Governor\nfor the following terms:\n1. Two (2) behavior analysts shall serve for one (1) year;\n2. Two (2) behavior analysts shall serve for three (3) years;\n3. A psychologist shall serve for two (2) years;\n4. One (1) parent shall serve for one (1) year; and\n5. One (1) parent shall serve for two (2) years;\n(b) The terms of subsequent board members shall be for three (3) years; and\n(c) A vacancy of any board member shall be filled in the manner of the original\nappointment for the unexpired portion of the term only or as provided by KRS\n12.070. The Governor, after notice and opportunity for a hearing, may remove\nany member of the board for malfeasance, neglect of duty, incompetency, or\nrevocation or suspension of a license.\n(3) Members of the board shall not receive a salary but shall be allowed the usual\nmileage, subsistence, and per diem as provided for members of state boards,\ncommissions, and committees. No member shall serve more than two (2)\nconsecutive terms.\n(4) The board may request the removal of a board member by the Governor.\n(5) The board shall annually elect a chair, vice chair, and secretary.\n(6) There shall be no liability on the part of, and no action for damages against, any\ncurrent or former board member , representative, agent, or employee of the board,\nwhen the person is functioning within the scope of board duties, acting without\nmalice and with the reasonable belief that the actions taken by him or her are\nwarranted by law.","path":["KRS Chapter 319C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31294","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"410f337dfa70084002cb7541f045d9476add4149104c09598ab0e50ccccc5720","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319c.020","next":"us-ky/krs-319c.040"},"notice":"GroundRules: Original legal text.
