{"data":{"id":"us-ky/krs-319c.050","jurisdiction":"us-ky","citation":"KRS 319C.050","heading":"Powers and duties of board.","body":"(1) It shall be the duty of the board to establish requirements for licensure to practice\napplied behavior analysis in the state in accordance with KRS 319C.060, to receive\napplications for licensure from persons desiring to become a behavior analyst, an\nassistant behavior analyst, or a temporary licensee from persons seeking to obtain\nsupervised experience in the state, and to determine whether those applicants meet\nthe qualifications and standards required by this chapter of all behavior analysts,\nassistant behavior analysts, or temporary licensees.\n(2) The board is an agency of state government with the power to institute criminal\nproceedings in the name of the Commonwealth against violators of this chapter, and\nto institute civil proceedings to enjoin any vi olation of this chapter. The board shall\ninvestigate every alleged violation of this chapter brought to the board's notice and\nshall take action as it may deem appropriate. It shall be the duty of the Attorney\nGeneral, the Commonwealth's attorneys, and the county attorneys to assist the board\nin prosecuting all violations of this chapter.\n(3) All meetings shall be held at the call of the chair or at a call of a majority of\nmembers upon not less than ten (10) days' written notice, unless notice shall be\nwaived. The presence of any member at any meeting of the board shall constitute a\nwaiver of notice thereof by the member.\n(4) The board may conduct investigations and schedule and conduct administrative\nhearings in accordance with KRS Chapter 13B to enforce th e provisions of this\nchapter or administrative regulations promulgated pursuant to this chapter. The\nboard shall have the authority to administer oaths, receive evidence, interview\npersons, issue subpoenas, and require the production of books, papers, docu ments,\nor other evidence. In case of disobedience to a subpoena, the board may invoke the\naid of the Franklin Circuit Court. Any order or subpoena of the court requiring the\nattendance or testimony of witnesses or the production of documentary evidence\nmay be enforced and shall be valid anywhere in the Commonwealth.\n(5) The board shall keep a minute book containing a record of all meetings of the\nboard.\n(6) The board shall maintain a register of all persons licensed under this chapter. This\nregister shall s how the name of every licensee in this state, his or her current\nbusiness and residence address and telephone numbers, and the date and number of\nhis or her license. A licensee shall notify the board of a change of name, address, or\ntelephone number, within thirty (30) days of the change.\n(7) The board's records shall be updated annually.\n(8) The board shall publish annually and make available a current directory of all\nlicensed behavior analysts, licensed assistant behavior analysts, and temporary\nlicensees obtaining supervised experience.\n(9) The board shall adopt a seal which shall be affixed to every license and certificate\ngranted by it.","path":["KRS Chapter 319C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31296","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"11ffb3ba19c163b634f498e2dde2fb1075f27c3cabdb9ba8f8c489213e384940","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319c.040","next":"us-ky/krs-319c.060"},"notice":"GroundRules: Original legal text.
