{"data":{"id":"us-ky/krs-319c.060","jurisdiction":"us-ky","citation":"KRS 319C.060","heading":"Board's powers to regulate practice of applied behavior analysis --","body":"Administrative regulations -- Fees.\n(1) The board shall have the right to regulate the practice of applied behavior analysis\nin the state including behavior analysts, assistant behav ior analysts, and temporary\nlicensees, including licensure, limitations of activities, supervision, and educational\nqualifications and continuing education requirements for behavior analysts, assistant\nbehavior analysts, temporary licensees and supervisees . The board shall administer\nand enforce the provisions of this chapter and shall have the responsibility of\nevaluating the qualifications of applicants for licensure.\n(2) The board shall promulgate administrative regulations in accordance with KRS\nChapter 13A relating to the licensure and regulation of behavior analysts, assistant\nbehavior analysts, and temporary licensees including:\n(a) Establishing standards for licensure, temporary licensure, limitations of\nactivities, supervision, and compliance with t he educational qualifications as\nrequired by KRS 319C.080 for behavior analysts, assistant behavior analysts,\nand temporary licensees;\n(b) Establishing the number of persons a licensed behavior analyst may supervise\nat one (1) time, including temporary licensees and supervisees;\n(c) Adopting a code of ethical standards and standards of practice for all licensed\nbehavior analysts, assistant behavior analysts, and temporary licensees;\n(d) Establishing a measure of continued competency as a condition of licens e\nrenewal and standards for suspension, revocation, or refusal to issue or renew\na license of a behavior analyst, assistant behavior analyst, or temporary\nlicensee;\n(e) Governing the physical and mental examination of behavior analysts, assistant\nbehavior analysts, and temporary licensees who may be impaired by reason of\na mental, physical, or other condition that impedes their ability to practice\ncompetently. For purposes of enforcing this section, the board shall have the\npower to order an immediate tempo rary suspension in accordance with KRS\n13B.125 if there is a reasonable cause to believe that a behavior analyst,\nassistant behavior analyst, temporary licensee, or applicant may be impaired\nby reason of a mental, physical, or other condition that impedes his or her\nability to practice competently; and\n(f) Establishing reasonable fees for the licensure and license renewal of behavior\nanalysts, assistant behavior analysts, and temporary licensees.","path":["KRS Chapter 319C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31297","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"4e84752780ac18d1a9e6d05e63ed8b56eb84eb3f1f44b7b37a65a5effd75a2a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319c.050","next":"us-ky/krs-319c.070"},"notice":"GroundRules: Original legal text.
