{"data":{"id":"us-ky/krs-320.310","jurisdiction":"us-ky","citation":"KRS 320.310","heading":"Causes for refusal, limitation, revocation, or suspension of licenses --","body":"Restitution or fines -- Branch offices -- Expungement.\n(1) The board may refuse to issue, refuse to renew, limit or restrict, revoke, or suspend\na license, may place on pr obation, or reprimand a licensee, may order restitution,\nmay impose a fine not to exceed one thousand dollars ($1,000) for each violation of\nthis chapter or the corresponding administrative regulations, or may impose any\ncombination of these penalties if it finds that an applicant or a licensee has:\n(a) Engaged in any practice of fraud or deceit in obtaining or attempting to obtain\na license;\n(b) Been convicted of any felony or has been convicted of a misdemeanor\ninvolving sexual misconduct, if in accordanc e with KRS Chapter 335B. A\nrecord of the conviction or a certified copy of the record shall be conclusive\nevidence of the conviction;\n(c) Chronic or persistent inebriety or addiction to a drug habit to an extent that\ncontinued practice is dangerous to patients or to the public safety;\n(d) Been granted a license upon a mistake of material fact;\n(e) Engaged in incompetence, as determined by the board;\n(f) Practiced as an itinerant, peddled from door to door, established a temporary\noffice, or practiced optometry outside of or away from his or her regular office\nor place of practice, except that the board may promulgate administrative\nregulations to authorize the practice of optometry outside of the licensee's\nregular office for a charitable purpose as defined by the board;\n(g) Employed, procured, induced, aided, or abetted any person, not holding a\nKentucky license, to practice optometry or in practicing optometry;\n(h) Used the title \"doctor\" or its abbreviation without further qualifying this title\nor abbrevia tion with the word \"optometrist\" or suitable words or letters\ndesignating an optometry degree;\n(i) Engaged in any conduct likely to deceive or defraud the public;\n(j) Violated any order issued by the board;\n(k) Had his or her license to practice optometry in any other jurisdiction revoked,\nsuspended, limited, placed on conditions of probation, or subjected to any\nother disciplinary action by that jurisdiction's licensing authority;\n(l) Prescribed any therapeutic agent in an amount that the optometrist knows , or\nshould know, is excessive under accepted and prevailing standards, or which\nthe optometrist knows, or has reason to know, will be used or is likely to be\nused other than for an accepted therapeutic purpose;\n(m) Developed a physical or mental disabilit y, or other condition, which renders\nthe continued practice by the optometrist dangerous to patients or the public;\n(n) Violated any statute under this chapter or administrative regulation\npromulgated under those statutes;\n(o) Violated KRS 304.39-215; or\n(p) Engaged in conduct that is subject to the penalties under KRS 304.99 -060(4)\nor (5).\n(2) Nothing in this section shall prevent an optometrist from establishing branch offices\nif each office contains minimum equipment as required by administrative regulation\nof the board, ensures patient care as necessary, and has a Kentucky licensed\noptometrist in charge of the office.\n(3) Any licensee, permit holder, or certificate holder who is disciplined under this\nchapter for a minor violation may request in writing  that the board expunge the\nminor violation from the licensee's, permit holder's, or certificate holder's\npermanent record.\n(a) The request for expungement may be filed no sooner than three (3) years after\nthe date on which the licensee, permit holder, or certificate holder has\ncompleted disciplinary sanctions imposed and if the licensee, permit holder, or\ncertificate holder has not been disciplined for any subsequent violation of the\nsame nature within this period of time.\n(b) No person may have his or her  record expunged under this chapter more than\nonce.\nThe board shall promulgate administrative regulations under KRS Chapter 13A to\nestablish violations which are minor violations under this subsection. A violation\nshall be deemed a minor violation if it d oes not demonstrate a serious inability to\npractice the profession; adversely affect the public health, safety or welfare; or\nresult in economic or physical harm to a person, or create a significant threat of such\nharm.","path":["KRS Chapter 320"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49067","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:16Z","sha256":"1caa69679472f948a8b8cabe230bcc04fa2c1d82fc3114fc61e7d34972b39c9a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-320.300","next":"us-ky/krs-320.312"},"notice":"GroundRules: Original legal text.
