{"data":{"id":"us-ky/krs-321.207","jurisdiction":"us-ky","citation":"KRS 321.207","heading":"Authorization to apply to United States Drug Enforcement Administration","body":"for controlled substance registration -- Certification of animal control agencies\nand animal euthanasia specialists -- Possession and storage of drugs used for\neuthanasia.\n(1) (a) The Kentucky Board of Veterinary Examiners, upon submission of a\ncomplete application and payment of a fee established by the board, shall\nissue to any animal control agency that it determines to be qualified, an\nauthorization to apply to the  United States Drug Enforcement Administration\n(DEA) for a controlled substance registration for the purchase, possession,\nstorage, and administration of the specific drugs approved by the board to\neuthanize or sedate animals for euthanasia for animals own ed by the certified\nanimal control agency, or in the case of emergency care related to injured,\nsick, or abandoned animals.\n(b) A certified animal control agency that successfully obtains a DEA controlled\nsubstance registration shall comply with all state and federal laws related to\nthe ordering, purchase, storage, tracking, management, and disposal of the\ndrugs obtained under the controlled substance registration.\n(c) A certified animal control agency shall comply with certification renewal\nrequirements as set forth in KRS 321.208 or the certificate shall expire.\n(2) A certified animal control agency shall comply with administrative regulations\npromulgated by the board which contain standards for proper storage and handling\nof the drugs the board has approved for this use, and any other provisions as may be\nnecessary to ensure that the drugs are used safely and solely for the purpose set\nforth in this section.\n(3) (a) A certified animal control agency shall submit to periodic inspections by the\nboard or its authorized representatives to ensure compliance with DEA\ncontrolled substance registration and board requirements.\n(b) An applicant for certification as a certified animal control agency shall submit\nto an inspection by the board or its authorized represen tatives prior to\ncertification by the board to ensure adequate security for controlled substances\nstorage.\n(c) A previously certified animal control agency with an expired certificate shall\nsubmit to inspections by the board or its authorized representativ es to ensure\nproper log updates, removal, and disposal of all drugs obtained under the\nDEA controlled substance registration.\n(4) Upon submission of a complete application, payment of a fee established by the\nboard, and successful completion of a board -approved animal euthanasia specialist\ntraining course by the applicant, the Kentucky Board of Veterinary Examiners shall\nissue to a person whom it determines to be qualified, a certificate for the person to\nfunction as a certified animal euthanasia specialist , subject to the following\nrestrictions:\n(a) A certified animal euthanasia specialist shall comply with certification\nrenewal requirements as set forth in KRS 321.208 or the certificate shall\nexpire;\n(b) A certified animal euthanasia specialist shall maintain an employment\nrelationship with a certifi ed animal control agency to be qualified to practice\nanimal euthanasia;\n(c) A certified animal euthanasia specialist is authorized to perform euthanasia\nonly on the premises of the certified animal control agency, except in case of\nemergency care;\n(d) A certified animal euthanasia specialist shall euthanize only animals that are\nowned by the certified animal control agency or in cases of emergency care.\nTransfer of ownership or a temporary contract shall not be used for the\npurpose of circumventing this subsection;\n(e) A certified animal euthanasia specialist shall not perform euthanasia at a\nprivate residence; and\n(f) A certified animal euthanasia specialist shall not perform euthanasia for\ncompensation, except for compensation from the certified animal eut hanasia\nspecialist's employment relationship with a certified animal control agency.\n(5) Euthanasia of animals in a certified animal control agency shall only be performed\nby:\n(a) A licensed veterinarian;\n(b) A licensed veterinary technician functioning un der the supervision of a\nlicensed veterinarian; or\n(c) A certified animal euthanasia specialist as provided for in subsection (4) of\nthis section.\n(6) A certified animal control agency that employs a certified animal euthanasia\nspecialist may purchase, possess, and administer the specific drugs approved by the\nboard in an administrative regulation for the euthanasia or sedation of animals for\neuthanasia. The specific drugs approved by the board shall be the only drugs used\nby certified animal euthanasia spe cialists for the euthanasia of animals or sedation\nof animals for euthanasia in a certified animal control agency.\n(7) Certified animal control agencies and certified animal euthanasia specialists shall be\nrequired to renew their certificates at intervals,  upon conditions, and upon the\npayment of fees established by the board through the promulgation of\nadministrative regulations.\n(8) (a) A veterinarian who is contracted or otherwise employed by an animal shelter\nshall not store drugs obtained under the vet erinarian's DEA controlled\nsubstance registration in the same locked storage unit where the drugs\nobtained under another DEA controlled substance registration are stored.\n(b) Separate and secure storage arrangements, drug logs, drug order forms, and\nsecure, limited access shall be required for each separate DEA controlled\nsubstance registration.\n(c) A veterinarian shall not store drugs ordered under the veterinarian's DEA\ncontrolled substance registration at an animal shelter unless the DEA\ncontrolled substance registration under which the drugs are ordered lists the\nanimal shelter address as the registrant address.","path":["KRS Chapter 321"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56283","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:16Z","sha256":"4ac54c7d525b45802e33eccef358c8d26256395bd6001c9eefbf8129d7f73e77","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.205","next":"us-ky/krs-321.208"},"notice":"GroundRules: Original legal text.
