{"data":{"id":"us-ky/krs-321.230","jurisdiction":"us-ky","citation":"KRS 321.230","heading":"Kentucky Board of Veterinary Examiners -- Membership -- Qualifications","body":"-- Appointment -- Terms -- Vacancies -- Compensation -- Removal of member.\nThere hereby is created a board to be known as the Kentucky Board of Veterinary\nExaminers.\n(1) The board shall consist of eleven (11) members:\n(a) Ten (10) members shall be appointed by the Governor as follows:\n1. Seven (7) members shall be citizens of the Commonwealth and shall be\nveterinarians, each lawfully engaged in the practice of veterinar y\nmedicine in this Commonwealth for at least two (2) years immediately\npreceding the date of the member's appointment;\n2. One (1) member shall be a citizen of the Commonwealth and shall be a\ncitizen at large who is not associated with or financially intere sted in the\npractices or businesses regulated;\n3. One (1) member shall be a citizen of the Commonwealth and a licensed\nveterinary technician who has been employed in the veterinary field in\nthe Commonwealth for at least two (2) years immediately preceding the\ndate of the member's appointment; and\n4. One (1) member shall be a licensed allied animal health professional\nwho has been working on animals in the Commonwealth for at least two\n(2) years immediately preceding the date of the member's appointment;\nand\n(b) One (1) member shall be the Commissioner of Agriculture or designee.\n(2) The Governor's appointments to the board shall maintain a composition that\nincludes diverse representation from each of the following areas:\n(a) Species of animals served, including food animals, equines, and small\nanimals; and\n(b) All regional areas of the Commonwealth, including eastern Kentucky, western\nKentucky, central Kentucky, and northern Kentucky.\n(3) All appointed members shall be appointed for a term of four (4) years and shall\nserve until the member is reappointed or a qualified successor is app ointed. The\nterms shall be evenly staggered, so that no more than three (3) members are\nappointed to full terms in any given calendar year.\n(4) Any vacancy in the appointed membership of the board shall be filled for the\nunexpired term by appointment by the Governor.\n(5) Each member of the board shall receive one hundred dollars ($100) per day for each\nday or substantial part of a day of service actually given in carrying out the\nmember's duties under this chapter, in addition to the member's necessary trav eling,\nhotel, and contingent expenses incurred in attending the meetings of the board and\nin the performance of the member's duties.\n(6) A board member may be removed by the Governor, or removed by a three -fourths\n(3/4) majority vote of the board upon one (1) or more of the following grounds:\n(a) A poor attendance record, neglect of duty, or malfeasance in office;\n(b) The refusal or inability for any reason of a board member to perform the\nduties as a member of the board in an efficient, responsible, and pr ofessional\nmanner;\n(c) The misuse of office by a member of the board to obtain financial or material\ngain or advantage personally or for another through the office;\n(d) A final adjudication by a recognized body, including the courts, that the board\nmember is in violation of the laws governing the practice of veterinary\nmedicine, the practice of veterinary technology, or other board credentialed\nprofession; or\n(e) Other just and reasonable causes as determined solely by the board pursuant\nto applicable law.
