{"data":{"id":"us-ky/krs-321.236","jurisdiction":"us-ky","citation":"KRS 321.236","heading":"Administrative regulations -- Registration requirements -- Voluntary","body":"inspections by the board -- Disciplinary action against registrant.\n(1) The board may promulgate administrative regulations in accordance with KRS\nChapter 13A defining:\n(a) Application, renewal, and reinstatement requirements and fees for veterinary\nfacilities and AAHP facilities;\n(b) Responsibilities and limitations for registered responsible parties, veterinarian\nmanagers, and AAHP managers. This shall include an admini strative\nregulation governing interference or control by unlicensed persons in the\npractice of veterinary medicine or veterinary technology, or by persons who\ndo not hold a board credential. Both registered responsible parties and\nveterinarian managers shall be responsible for a registered veterinary facility's\noperation and management, and both registered responsible parties and AAHP\nmanagers shall be responsible for a registered AAHP facility. Both parties\nassociated with a registered facility shall be held accountable to the board as a\ncredential holder for any violation of this chapter; and\n(c) Minimum standards for veterinary facilities, mobile facilities, and AAHP\nfacilities, including requirements for application, inspection, sanitation, and\nother factors.\n(2) (a) All existing veterinary facilities and AAHP facilities, both fixed and mobile,\nshall be registered with the board not later than June 30, 2025.\n(b) The board shall charge a minimum fee of two hundred dollars ($200) per\ninitial registration.\n(c) For initial registrations filed with the board by June 30, 2025, the initial\nregistration fee shall be reduced by half to one hundred dollars ($100).\n(d) After initial registration, the board shall not charge more for a facility\nregistration renewal fee than the cost to run the registration program.\n(3) (a) After June 30, 2025, all new facilities shall submit a completed application for\nregistration to the board, including fees as promulgated by the board in\nadministrative regulation.\n(b) A new veterinary facility or AAHP facility shall not begin operation in  the\nCommonwealth until the completed application and fee have been accepted\nby the board and notification in writing has been sent to the applicant.\n(c) After the registration deadline in 2025, each new registered facility may be\ninspected by the board to  verify that the facility is an operational veterinary\nfacility or AAHP facility within the first one hundred twenty (120) days of\noperation.\n(4) A mobile facility that is affiliated with a registered veterinary facility or AAHP\nfacility shall be exempted from the requirement to register independently if a\ncurrently registered fixed facility identifies that unit as its affiliate. The board may\ncharge additional registration fees to a registered veterinary facility or AAHP\nfacility based upon the number of r egistered mobile units associated with a single\nfacility registration through the promulgation of an administrative regulation in\naccordance with KRS Chapter 13A.\n(5) Each application to register a veterinary facility or an AAHP facility shall meet the\nminimum requirements established by this chapter and the board in an\nadministrative regulation promulgated in accordance with KRS Chapter 13A and\nidentify the following persons responsible for its operation and management:\n(a) The registered responsible party;\n(b) The veterinarian manager, if a veterinary facility; or\n(c) The AAHP manager, if an AAHP facility.\n(6) (a) The veterinarian manager shall include at least one (1) Kentucky -licensed\nveterinarian with an active license in good standing with the board.\n(b) The AAHP manager shall include at least one (1) Kentucky -licensed AAHP\nwith an active license in good standing with the board.\n(7) (a) The veterinarian manager and the registered responsible party are responsible\nfor notifying the board of any change in  the veterinarian manager's or\nregistered responsible party's association with the veterinary facility.\n(b) The AAHP manager and the registered responsible party are responsible for\nnotifying the board of any change in the allied animal health professional 's or\nregistered responsible party's association with the AAHP facility.\n(8) An application for registration renewal shall be completed and submitted to the\nboard periodically after the initial registration deadline in 2025, in accordance with\nKRS 321.203 and as set forth in administrative regulations promulgated in\naccordance with KRS Chapter 13A.\n(9) The board may conduct voluntary inspections in accordance with the following:\n(a) Veterinary facilities and AAHP facilities shall be provided an option to\nconduct a self -inspection at the facility and may consult with the board or\nrequest a board inspection to ensure the facility is meeting minimum\nstandards as established in administrative regulations promulgated in\naccordance with KRS Chapter 13A;\n(b) The bo ard may charge a fee for in -person consultations and inspections as\nestablished in an administrative regulation promulgated in accordance with\nKRS Chapter 13A;\n(c) Voluntary consultations or inspections by the board shall not trigger a notice\nto comply or a notice of violation for deficiencies. Nothing in this paragraph\nshall be construed to limit the board from filing a grievance based upon a\nsignificant violation impacting public health, safety, and welfare, and animal\nhealth;\n(d) Each registered facility  that passes a voluntary, in -person inspection by the\nboard shall receive a certificate of inspection from the board for display in the\nregistered facility;\n(e) Inspections of mobile units shall not extend into a registrant's private\nresidence; and\n(f) This subsection shall not prevent the board from conducting inspections at or\nimplementing disciplinary action against a registered facility in response to a\ncomplaint, grievance, or upon a suspected violation of this chapter.\n(10) The board may revoke, suspe nd, or take other disciplinary action deemed\nappropriate against the registrant, including ordering closure of the veterinary\nfacility or AAHP facility, in accordance with KRS 321.351 and 321.353 on any of\nthe following grounds:\n(a) The board or its agents  are denied access to conduct an inspection or\ninvestigation;\n(b) The holder of a registration does not pay all prescribed fees or monetary\npenalties;\n(c) There is no veterinarian manager or AAHP manager identified within the\ntimeframes set by this chapter;\n(d) Registered responsible parties are interfering with, exercising control over, or\nattempting to influence the professional judgment of a credential holder in any\nmanner;\n(e) Failure to comply with minimum standards defined in an administrative\nregulation promulgated by the board for the veterinary facility or AAHP\nfacility; or\n(f) Failure to comply with any provision of this chapter or administrative\nregulations promulgated under this chapter.\n(11) The board may require any veterinarian manager applicant, AAHP manager\napplicant, or registered responsible party applicant to submit to a criminal\nbackground investigation conducted in accordance with KRS 321.189.","path":["KRS Chapter 321"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56285","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:16Z","sha256":"d7e01ab211d136a7a3c15ac5b80bb3a3eb300c82e1b3849355457aadd461ca13","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.235","next":"us-ky/krs-321.237"},"notice":"GroundRules: Original legal text.
