{"data":{"id":"us-ky/krs-321.237","jurisdiction":"us-ky","citation":"KRS 321.237","heading":"Veterinary wellness committee.","body":"(1) The board may establish a veterinary wellness committee to undertake the functions\nand responsibilities of a veterinary wellness program. The functions and\nresponsibilities may include any of the following:\n(a) Receiving and evaluating reports of suspected  impairment or incapacitation\nfrom any source;\n(b) Issuing an order directing an applicant, certificate holder, licensee, designated\non-site manager, permittee, registrant, veterinarian manager, or AAHP\nmanager to undergo a mental or physical examination o r chemical\ndependency evaluation, when probable cause exists that the credential holder\nhas engaged in conduct prohibited by this chapter or a statute or\nadministrative regulation enforced by the board. For the purpose of this\nsection, every credential hol der is considered to have consented to undergo a\nmental or physical examination or chemical dependency evaluation when\nordered to do so, in writing, by the board and to have waived all objections to\nthe admissibility of the examiner's or evaluator's testim ony or reports on the\ngrounds that the testimony or reports constitute a privileged communication;\n(c) Intervening in cases of verified or suspected impairment or incapacitation; or\n(d) Referring impaired or incapacitated credential holders, registrants, d esignated\non-site managers, veterinarian managers, AAHP managers, or applicants to\ntreatment programs as a requirement of initial or continued licensure,\ncertification, registration, or permitting.\n(2) Other provisions of law notwithstanding, all board and  committee records\npertaining to the veterinary wellness program shall be kept confidential. No person\nin attendance at any meeting of the committee shall be required to testify as to any\ncommittee discussions or proceedings.\n(3) Other provisions of law no twithstanding, no member of the board or the veterinary\nwellness committee shall be liable for damages to any person for any acts,\nomissions, or recommendations made by the member in good faith while acting\nwithin the scope of the member's responsibilities in accordance with this section.","path":["KRS Chapter 321"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53942","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:16Z","sha256":"a9d9716cf83cde7544a838e152cc5cdfc126ab206dcd756aa5a6cc942f81d818","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.236","next":"us-ky/krs-321.240"},"notice":"GroundRules: Original legal text.
