{"data":{"id":"us-ky/krs-321.353","jurisdiction":"us-ky","citation":"KRS 321.353","heading":"Emergency order for immediate, temporary suspension of license,","body":"certificate, permit, or registration when necessary to protect the public -- Right\nto appeal.\n(1) The board may, by a majority vote, issue an emergency order for the immediate,\ntemporary suspension of a license, certificate, permit, or registration against which\ndisciplinary action, an investigation, or initiating complaint is pending if the order is\nnecessary to protect the public.\n(2) The emergency order shall be made in accorda nce with KRS 13B.125 and shall be\nbased upon a finding by the board that the emergency order is in the public interest\nand that there is substantial evidence of immediate danger to the health, welfare,\nand safety of the credential holder's clients, animals, or the general public.\n(3) A licensee, certificate holder, permittee, or registrant may appeal the emergency\norder by filing a written request to the board for an emergency hearing in\naccordance with KRS 13B.125 within thirty (30) days after receipt of the order.\n(4) The appeal of an emergency order shall address only the necessity for the action\nand shall not constitute an appeal of the merits of the underlying complaint or\ncharge.\n(5) The emergency order shall remain in effect until modified or vacated by the board\nor hearing officer or superseded by final disciplinary action of the board or hearing\nofficer on the underlying complaint or charge.\n(6) The board shall expedite disciplinary hearings in which a licensee, certificate\nholder, permittee, or regi strant has been suspended under subsection (1) of this\nsection.\n(7) Any party aggrieved by a final order of the board may appeal to the Franklin Circuit\nCourt after a written decision is issued by the board in accordance with KRS\nChapter 13B.","path":["KRS Chapter 321"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53946","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:17Z","sha256":"e8909473b9ac4acea7bddb1c66d122aac99a3841afe9db3649201c8dd5977d0e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.352","next":"us-ky/krs-321.360"},"notice":"GroundRules: Original legal text.
