{"data":{"id":"us-ky/krs-321.441","jurisdiction":"us-ky","citation":"KRS 321.441","heading":"Veterinary technician's license -- Qualifications -- Scope of practice --","body":"Annual fee -- Exception.\n(1) The board shall issue a license as a veterinary technician to an applicant who:\n(a) Is a graduate of an approved veterinary technology prog ram with an associate\nor bachelor's degree related to veterinary technology;\n(b) Obtains a passing score on an examination as determined by the board to\nassess the qualifications and fitness of an applicant to engage in the practice;\n(c) Is a person of goo d moral character. As one (1) element of good moral\ncharacter, the board shall require each applicant for licensure to submit a full\nset of the applicant's fingerprints for the purpose of obtaining criminal records\nchecks, pursuant to applicable law. All g ood moral character information,\nincluding the information obtained through the criminal background checks,\nshall be relevant to licensure eligibility determinations to the extent permitted\nby law;\n(d) Has met all the requirements of the board as establish ed by administrative\nregulation of the board; and\n(e) Has been approved for licensure by the board.\n(2) For the purpose of this chapter, \"veterinary technician,\" \"veterinary technologist,\"\n\"veterinary nurse,\" or any other category of veterinary technician defined by the\nboard in administrative regulation shall have the same meaning as \"veterinary\ntechnician\" under this chapter.\n(3) The board shall promulgate administrative regulations for one (1) or more\ncategories of veterinary technicians defining the:\n(a) Minimum qualifications required;\n(b) Specific tasks that the licensee may perform under a veterinarian's\nsupervision; and\n(c) Specific tasks that the licensee shall not perform.\n(4) A veterinary technician shall be prohibited from performing the activities listed in\nKRS 321.190(6).\n(5) The practice of veterinary technology by telehealth or other means shall constitute\nthe practice of veterinary technology subject to licensure and enfo rcement by the\nboard.\n(6) A veterinary technician who performs veterinary technology contrary to this chapter\nand its associated administrative regulations shall be subject to disciplinary actions\nin a manner consistent with this chapter applicable to licensed veterinarians.\n(7) Each veterinary technician licensed by the board shall pay an annual fee as\nprescribed by the board.\n(8) Each veterinary technician licensed by the board shall complete annual continuing\neducation hours to renew the license as requi red by the board in administrative\nregulation.\n(9) Failure to renew shall result in the expiration of the license.\n(10) A veterinarian shall utilize the services of a licensed veterinary technician in\naccordance with the terms and provisions of this chapte r and its associated\nadministrative regulations. Unauthorized utilization of licensed veterinary\ntechnicians by veterinarians shall be considered as aiding and abetting any\nunlicensed person to practice veterinary medicine as described in KRS 321.351.\n(11) Nothing in this section shall prohibit volunteer health practitioners from providing\nservices under KRS 39A.350 to 39A.366.\n(12) Except as authorized by KRS 321.200, no person shall practice as a veterinary\ntechnician or perform any of the duties usually performed by a veterinary technician\nunless the person holds a license to practice as a veterinary technician issued and\nvalidly existing under this chapter.","path":["KRS Chapter 321"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53948","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:17Z","sha256":"ed8e0d79ee292b36500a081be2b141b41da100f5b6da26101cf596258585fad6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.440","next":"us-ky/krs-321.442"},"notice":"GroundRules: Original legal text.
