{"data":{"id":"us-ky/krs-321.990","jurisdiction":"us-ky","citation":"KRS 321.990","heading":"Penalties.","body":"(1) Any person who violates or aids in the violation of KRS 321.190, 321.201,\n321.207, 321.236, 321.441, or 321.443 for practicing or for performing services\nwithout a credential required by the board shall be guilty of a misdemeanor upon\nconviction in court, and shall be sentenced to jail for not less than ten (10) days nor\nmore that ninety (90) days per violation.\n(2) Any person exercising or attempting to exercise control over, interfering with, or\nattempting to influence the professional judgment of a crede ntial holder in any\nmanner, including through coercion, collusion, extortion, inducement, or\nintimidation, shall be guilty of a misdemeanor upon conviction in court, and shall\nbe sentenced to jail for not less than ten (10) days nor more that ninety (90) d ays\nper violation.\n(3) Any person who resists, obstructs, interferes with, threatens, attempts to intimidate,\nor in any other manner interferes with an agent of the board or who willfully refuses\nto obey their lawful orders shall be guilty of a misdemeanor  upon conviction in\ncourt, and shall be sentenced to jail for not more than thirty (30) days for each\noffense.\n(4) Each day or part of a day that a violation continues is a separate violation and\nsubject to daily penalties.\n(5) Nothing in this section shall limit, preclude, or supersede the board's power to:\n(a) Impose fines for a violation of this chapter or any administrative regulations\npromulgated under this chapter;\n(b) Deny, restrict, or revoke a license issued under this chapter or administrative\nregulations promulgated under this chapter; and\n(c) Impose any other form of discipline based on a conviction under this section\nor as otherwise authorized by this chapter or administrative regulations\npromulgated under this chapter.","path":["KRS Chapter 321"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53951","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:17Z","sha256":"d0c75d46262f960b23328456d74e71a813244d3efbcca8eff0071e06e0a5920f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.450","next":"us-ky/krs-322.010"},"notice":"GroundRules: Original legal text.
