{"data":{"id":"us-ky/krs-322.010","jurisdiction":"us-ky","citation":"KRS 322.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Board\" means the State Board of Licensure for Professional Engineers and Land\nSurveyors;\n(2) \"Engineer\" means a person who is qualified to engage in the practice of professional\nengineering by reason of special knowledge and use of:\n(a) The mathematical, physical, and engineering sciences; and\n(b) The principles and methods of engineering analysis and design, acquired by\nengineering education and practical engineering experience;\n(3) \"Professional engineer\" means a person who is licensed as a professional engineer\nby the board;\n(4) \"Engineering\" means any professional service or creative work, the adequate\nperformance of which requires engineering education, training, and experience as an\nengineer.\n(a) \"Engineering\" shall include:\n1. Consultation, investigation, evaluation, planning, certification, and\ndesign of engineering works and systems;\na. Engineering design and engineering work associated with\ndesign/build projects;\nb. Engineering wor ks and systems which involve earth materials,\nwater or other liquids, and gases;\nc. Planning the use of land, air, and waters; and\nd. Performing engineering surveys and studies;\n2. The review of construction for the purpose of assuring compliance with\ndrawings and specifications; any of which embraces this service or\nwork, either public or private, in connection with any utilities, structures,\ncertain buildings, building systems, mac hines, equipment, processes,\nwork systems, or projects with which the public welfare or the\nsafeguarding of life, health, or property is concerned, when that\nprofessional service or work requires the application of engineering\nprinciples and data;\n3. The teaching of engineering design courses in any program accredited by\nthe Engineering Accreditation Commission of the Accreditation Board\nfor Engineering and Technology or any engineering program deemed\nequivalent by the board;\n4. The negotiation or solicitat ion of engineering services on any project in\nthis state, regardless of whether the persons engaged in the practice of\nengineering:\na. Are residents of this state;\nb. Have their principal place of business in this state; or\nc. Are in responsible charge of the engineering services performed;\nand\n5. The services of a professional engineer who engages in the practice of\nland surveying incident to the practice of engineering that does not relate\nto the location or determination of land boundaries.\n(b) \"Engineering\" shall not include the professional services performed by\npersons who:\n1. Develop or administer construction project safety programs,\nconstruction safety compliance, construction safety rules or regulations,\nor related administrative regulations; or\n2. Only operate or maintain machinery or equipment;\n(5) \"Practice of engineering\" means the performance of any professional service\nincluded in subsection (4)(a) of this section;\n(6) \"Engineer in training\" means a person who has passed the Fundamentals of\nEngineering Examination and is otherwise qualified to earn experience toward\nlicensure as a professional engineer;\n(7) \"Responsible charge of engineering\" means direct control and personal supervision\nof engineering, or teaching experience with the rank equi valent to assistant\nprofessor or higher in a board-approved engineering program;\n(8) \"Land surveyor\" means a person who is qualified to engage in the practice of land\nsurveying by reason of special knowledge and use of mathematics, the physical and\napplied sciences, and the principles and methods of land surveying, acquired by\neducation and practical experience in land surveying;\n(9) \"Professional land surveyor\" means a person who is licensed as a professional land\nsurveyor by the board;\n(10) \"Land surveyin g\" means any professional service or work, the adequate\nperformance of which requires the education, training, and experience as a land\nsurveyor.\n(a) \"Land surveying\" shall include but not be limited to the following:\n1. Measuring and locating, establishin g, or reestablishing lines, angles,\nelevations, natural and man -made features in the air, on the surface and\nimmediate subsurface of the earth, within underground workings, and on\nthe beds or surfaces of bodies of water involving the:\na. Determination or e stablishment of the facts of size, shape,\ntopography, and acreage;\nb. Establishment of photogrammetric and geodetic control that is\npublished and used for the determination, monumentation, or\ndescription of property boundaries;\nc. Subdivision, division, and consolidation of lands;\nd. Measurement of existing improvements, including condominiums,\nafter construction and the preparation of plans depicting existing\nimprovements, if the improvements are shown in relation to\nproperty boundaries;\ne. Layout of proposed improvements, if those improvements are to be\nreferenced to property boundaries;\nf. Preparation of subdivision record plats;\ng. Determination of existing grades and elevations of roads and land;\nh. Creation and perpetuation of alignments related to maps, record\nplats, field note records, reports, property descriptions, and plans\nand drawings that represent them; and\ni. Certification of documents;\n2. The negotiation or solicitation of land surveying s ervices on any project\nin this state, regardless of whether the persons engaged in the practice of\nland surveying:\na. Are residents of this state;\nb. Have their principal office or place of business in this state; or\nc. Are in responsible charge of the lan d surveying services or work\nperformed; and\n3. The preparation of survey descriptions for use in legal instruments\naffecting real property or property rights. \"Land surveying\" does not\ninclude the preparation of a physical description that identifies and\ndescribes the tract, parcel, or lot by reference to the tract, parcel, lot,\nblock, or unit number of any subdivision, or other summary identifier\nappearing on a properly recorded plat of record, or by reference to a deed\nof record.\n(b) \"Land surveying\" shall not include:\n1. The measurement of crops or agricultural land area under any\nagricultural program sponsored by an agency of the federal government\nor the state of Kentucky;\n2. The services of a professional engineer who engages in the practice of\nland su rveying incident to the practice of engineering, if the land\nsurveying work does not relate to the location or determination of land\nboundaries; or\n3. The design of grades and elevations of roads and land;\n(11) \"Practice of land surveying\" means the perfor mance of any professional service\nincluded in subsection (10)(a) of this section;\n(12) \"Land surveyor in training\" means a person who has passed the Fundamentals of\nLand Surveying Examination and is otherwise qualified to earn experience toward\nlicensure as a professional land surveyor;\n(13) \"Responsible charge of land surveying\" means direct control and personal\nsupervision of land surveying, or teaching experience with the rank equivalent to\nassistant professor or higher in a board-approved land surveying program;\n(14) \"Business entity\" means a corporation, partnership, limited liability company,\nlimited partnership, or firm;\n(15) \"Offer to practice\" means:\n(a) A promise or commitment to engage in any act directly related to engineering\nor land surveying;\n(b) Undertaking to engage in the practice of engineering or land surveying; or\n(c) Any claim, express or implied, by any person representing himself or herself\nto be a professional engineer or professional land surveyor;\n(16) \"Certification\" means affixing a seal or stamp, signature, and date by a professional\nengineer or professional land surveyor to represent that the services or work\naddressed therein was performed by that professional engineer or professional land\nsurveyor according to his or her knowle dge, information, and belief, and that it was\ncompleted in accordance with applicable standards of practice. \"Certification\" shall\nnot mean a guaranty or warranty, either express or implied;\n(17) The \"Fundamentals of Engineering Examination\" means the exam ination with that\nname developed by the National Council of Examiners for Engineering and\nSurveying;\n(18) The \"Fundamentals of Land Surveying Examination\" means the examination with\nthat name developed by the National Council of Examiners for Engineering a nd\nSurveying;\n(19) The \"Principles and Practice of Engineering Examination\" means the examination\nwith that name developed by the National Council of Examiners for Engineering\nand Surveying; and\n(20) The \"Principles and Practice of Land Surveying Examinati on\" means the\nexamination with that name developed by the National Council of Examiners for\nEngineering and Surveying.","path":["KRS Chapter 322"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31417","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:17Z","sha256":"022ad512273776d74fa80f7c4298ba5247ca2acf672c7ebd71247774dfc6a955","source_id":"us-ky","stale":false,"prev":"us-ky/krs-321.990","next":"us-ky/krs-322.015"},"notice":"GroundRules: Original legal text.
