{"data":{"id":"us-ky/krs-322.290","jurisdiction":"us-ky","citation":"KRS 322.290","heading":"Functions of board.","body":"The board shall:\n(1) Administer this chapter;\n(2) Adopt an official seal;\n(3) Provide suitable office quarters at its own expense;\n(4) Adopt and amend all bylaws and rules of procedure, and promulgate administrative\nregulations, consistent with the Constitution and laws of the state and reasonably\nnecessary for the proper performance of its duties and the regulation and fair\nconduct of the proceedings before it;\n(5) Appoint an executive director and assistant executive directors and fix their\ncompensation;\n(6) Employ any clerk or other assistants necessary  for the proper performance of its\nwork;\n(7) Appoint a general counsel and any assistant general counsel as it deems necessary\nand fix their compensation;\n(8) Appoint investigatory personnel, as it deems necessary, and fix their compensation;\n(9) Appoint committees of licensees, as it deems necessary, to review issues before the\nboard and make recommendations to the board;\n(10) Make expenditures, as it deems necessary, for any purpose that it considers\nreasonably necessary for the proper performance of its duties, including paying the\nexpenses of the board's delegates to national conventions of and membership dues\nto the National Council of Examiners for Engineering and Surveying or other\naffiliated national boards or societies;\n(11) Adopt and promulgate by administrative regulation a code of professional practice\nand conduct, which shall be based upon generally recognized principles of\nprofessional ethical conduct and binding upon persons licensed under this chapter.\nA code of professional practice and condu ct shall be made known to all licensees\nand applicants and shall include but not be limited to the following objectives:\n(a) The protection of the public health, safety, and welfare;\n(b) The maintenance of standards of objectivity, truthfulness, and reliability in\npublic statements;\n(c) The avoidance of conflicts of interest;\n(d) The prohibition of solicitation or acceptance of engineering or land surveying\nwork on any basis other than qualifications for the work offered;\n(e) The prohibition of association with any person engaging in illegal or dishonest\nactivities; and\n(f) The limitation of professional service to the area of competence of the\nlicensee;\n(12) Adopt appropriate standards of practice;\n(13) Promulgate administrative regulations in accordance with KRS Chapter 13A to\nestablish rules for the use of stamps, seals, and signatures in electronic transactions;\n(14) Bring, in its name, injunctive proceedings in the Franklin Circuit Cour t to enjoin\nany person, business entity, or combination thereof in violation of KRS 322.020 or\nKRS 322.060;\n(15) Adopt a program for continuing education for its individual land surveyor licensees.\nNo individual land surveyor licensee shall be permitted to  renew his or her license\nunless the minimum annual continuing education requirements are met, in addition\nto any other requirement for renewal. The program for continuing education shall\nnot exceed a total of eight (8) credit clock hours per year and shal l not include\ntesting or examination of the licensee in any manner; and\n(16) Adopt a program for continuing education for its individual engineer licensees.\n(a) The program for continuing education shall not exceed a total of fifteen (15)\ncredit clock hours per year and shall not include testing or examination of the\nlicensee in any manner.\n(b) No individual engineer licensee shall be permitted to renew his or her license\nunless the minimum annual continuing education requirements are met,\nexcept as provided in paragraph (c) of this subsection, in addition to any other\nrequirement for renewal.\n(c) Any person licensed under this chapter as a professional engineer prior to\nJanuary 1, 1972, who has maintained his or her license in good standing since\nbecoming l icensed shall not be subject to any continuing education\nrequirements.","path":["KRS Chapter 322"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31448","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:17Z","sha256":"ee44d3eea09f6046f16b9008663953218260817e6caabc26b43bb068d82547e7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-322.280","next":"us-ky/krs-322.300"},"notice":"GroundRules: Original legal text.
