{"data":{"id":"us-ky/krs-323.130","jurisdiction":"us-ky","citation":"KRS 323.130","heading":"Hearing in disciplinary action -- Appeal.","body":"(1) In any action taken pursuant to KRS 323.120, the board shall conduct a hearing in\naccordance with the provisions of this chapter and KRS Chapter 13B. The hearing\nmay be conducted by the full board or at its designation, a member thereof, a panel\nof the board, a hearing officer, or a combination of the foregoing;\n(2) If the hearing is conducted by less than a majority of the full board, or by a hearing\nofficer, the board members or hearing officer, as the case may be, may only issue a\nrecommended order, and the recommended order shall be subject to review by a\nmajority of the full board, which shall issue a final order; and\n(3) The board may proceed against a licensee on its own initiative, on the basis of either\ninformation contained in its own records or in formation obtained through its\ninformal investigation. If a formal complaint verified by affidavit is filed with the\nboard by a responsible citizen or organization, containing allegations that if true\nwould warrant action pursuant to KRS 323.120, the board  may proceed against the\nlicensee.\n(4) Any final order of the board may be appealed to Franklin Circuit Court in\naccordance with KRS Chapter 13B.","path":["KRS Chapter 323"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31495","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:18Z","sha256":"fab2a339ae8a351d0e004127719bc4ef852b2001c35692b849047103b471cca7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-323.120","next":"us-ky/krs-323.140"},"notice":"GroundRules: Original legal text.
