{"data":{"id":"us-ky/krs-324.020","jurisdiction":"us-ky","citation":"KRS 324.020","heading":"Activities unlawful without license -- Requirement of licensing --","body":"Application of chapter to owner or builder -developer -- Prohibition against fee\nsplitting -- Exceptions -- Supervision of sales associate -- Authority to seek\ninjunctive relief.\n(1) It shall be unlawful for any person who is not licensed as a real estate broker or\nsales associate to:\n(a) Hold himself or herself out to the public as a real estate broker or sales\nassociate or use any terms, titles, or abbreviations which express,  infer, or\nimply that the person is licensed as a real estate broker or sales associate; or\n(b) Advertise for sale an equitable interest in a contract for the purchase of real\nproperty between a property owner and a prospective purchaser.\n(2) No person sha ll practice real estate brokerage with respect to real estate located in\nthis state unless:\n(a) The person holds a license to practice real estate brokerage under this chapter;\nor\n(b) The person has complied with KRS 324.235 to 324.238.\n(3) A licensee who is an owner or a builder-developer shall comply with the provisions\nof this chapter and the administrative regulations applying to real estate brokers and\nsales associates.\n(4) No broker shall split fees with or compensate any person who is not licensed to\nperform any of the acts regulated by this chapter, except that a broker may:\n(a) Pay a referral fee to a broker licensed outside of Kentucky for referring a\nclient to the Kentucky broker;\n(b) Pay a commission or other compensation to a broker licensed out side of\nKentucky in compliance with KRS 324.235 to 324.238; or\n(c) Pay a licensed auctioneer for services rendered in cases where an auctioneer\nand real estate broker collaborate in the conduct of a sale of real estate at\nauction.\n(5) Except as authorized in KRS 324.112(1) and 324.425, no sales associate shall\nsupervise another licensed sales associate or manage a real estate brokerage office.\n(6) The Kentucky Real Estate Commission may seek and obtain injunctive relief\nagainst any individual acting in violation of this chapter by filing a civil action in\nthe Circuit Court  where the commission is located or where the unlawful activity\ntook place.","path":["KRS Chapter 324"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53890","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:19Z","sha256":"3d191efa89cb9ef5e0fc1fa2d5c2ec819f4949f1f7e910dab574cdf34229788c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324.010","next":"us-ky/krs-324.030"},"notice":"GroundRules: Original legal text.
