{"data":{"id":"us-ky/krs-324.045","jurisdiction":"us-ky","citation":"KRS 324.045","heading":"Qualifications for license -- Examination -- Fee -- Criminal record check.","body":"(1) Licenses shall be granted only to persons who are trustworthy and competent to\ntransact the business of a broker or sales associate in a manner to safeguard the\ninterest of the public, and only after satisfactory proof of qualifications has been\npresented to the commission.\n(2) In addition to proof of honesty, truthfulness, and good reputation of any applicant\nfor a license, each applicant shall pass a written examination conducted by the\ncommission, or its authorized representative. The examination sha ll be of the scope\nand wording sufficient in the judgment of the commission to establish the\ncompetency of the applicant to act as a broker or sales associate in a manner to\nprotect the interests of the public. However, an examination shall not be required\nfor the renewal of any present or future license, unless the license has been revoked,\nsuspended, or is allowed to expire without renewal for a period of more than one (1)\nyear.\n(3) The commission shall hold examinations at the times and places it determi nes, and\nan examination fee shall be collected from each applicant to defray the expenses of\nholding the examinations.\n(4) The commission may, by the promulgation of administrative regulations, require all\nlicensure applicants to submit to a criminal recor d check for which the applicant\nshall be responsible for the payment of any fees incurred.\n(5) Applicants shall be subject to a national criminal history check through the Federal\nBureau of Investigation. The applicant shall request the criminal history ch eck and\nshall provide the applicant's fingerprints to either the Federal Bureau of\nInvestigation or the Kentucky State Police for submission to the Federal Bureau of\nInvestigation to search for information regarding the applicant in the National\nCrime Information Center or its successor entity. The results of the criminal history\ncheck shall be sent to the commission, and shall be sent to the applicant at the\napplicant's request. The applicant shall:\n(a) Authorize release of the results of the criminal hist ory check to the\ncommission;\n(b) Pay the actual cost of the fingerprinting and criminal history check, if any;\n(c) Complete the criminal history check within the ninety (90) calendar days prior\nto the date the license application is received by the commission; and\n(d) Complete and return to the commission within one hundred twenty (120) days\na signed affidavit verifying that there is nothing on record to prohibit the\napplicant from licensure.","path":["KRS Chapter 324"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31550","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:19Z","sha256":"dae2ebfecdbaa780809ca69384461f714f483792cddd433899e1dd00b3dac325","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324.040","next":"us-ky/krs-324.046"},"notice":"GroundRules: Original legal text.
