{"data":{"id":"us-ky/krs-324.150","jurisdiction":"us-ky","citation":"KRS 324.150","heading":"Investigation of licensee -- Disciplinary action against licensee --","body":"Investigative powers of commission -- Emergency hearings.\n(1) (a) The commission or its staff may on its own initiative investigate the actions of\nany licensee or any person who acts in that capacity. On the verified written\ncomplaint of any person, the commission shall investigate the actions of any\nperson who assumes to act in that capacity, if the complaint, together with any\nevidence presented in connection with it, alleges a prima  facie case that a\nviolation set out in KRS 324.160 has been committed. After the investigation,\nthe commission may order a hearing and, in appropriate cases, take\ndisciplinary action against any licensee who is found in violation of KRS\n324.160.\n(b) The c ommission may conduct an emergency hearing when alleged escrow\naccount violations warrant emergency action. The commission shall\npromulgate administrative regulations to describe the specific circumstances\nand allegations that authorize emergency action. T he emergency hearing shall\nbe conducted in accordance with KRS Chapter 13B, as it relates to emergency\norders and emergency hearings.\n(2) To investigate allegations of practices violating the provisions of this chapter, the\ncommission may:\n(a) Issue subpoe nas to compel attendance of witnesses and the production of\nbooks, papers, documents, or other evidence;\n(b) Administer oaths;\n(c) Review evidence;\n(d) Enter the office or branch office of any principal broker for the purpose of\ninspecting all documents re quired by the commission to be maintained in the\nprincipal broker's office or branch office which relate to the allegations of\npractices violating the provisions of this chapter;\n(e) Examine witnesses; and\n(f) Pay appropriate witness fees.","path":["KRS Chapter 324"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31576","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:19Z","sha256":"5c683cfc5b429f59593281b406472a448ad62a484863cdeb6c1ec9457d09d6f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324.142","next":"us-ky/krs-324.151"},"notice":"GroundRules: Original legal text.
