{"data":{"id":"us-ky/krs-324.238","jurisdiction":"us-ky","citation":"KRS 324.238","heading":"Compliance with KRS 324.160(4) and 324.235 to 324.238 -- Sanctions and","body":"penalties.\nFor purposes of KRS 324.235 to 324.238:\n(1) A person licensed in a jurisdiction where there is not a legal distinction between a\nreal estate principal broker and a real estate broker or salesperson shall satisfy the\nrequirements of an out-of-state principal broker;\n(2) Preliminary exchanges of information and materials, discussions, and investment or\nother advice pertaining to commercial real estate shall not constitute a cts of real\nestate brokerage by out-of-state principal brokers or out-of-state licensees;\n(3) If any change in circumstances prevents compliance by the out -of-state principal\nbroker or out-of-state licensee, that person shall immediately cease and desist f rom\nperforming acts of real estate brokerage with respect to commercial real estate; and\n(4) The commission may impose one (1) or more of the following sanctions or\npenalties against an out -of-state principal broker or an out -of-state licensee for\nfailure to substantially comply with KRS 324.235 to 324.238 or for engaging in\nimproper conduct as set out in KRS 324.160(4):\n(a) Levy fines not to exceed one thousand dollars ($1,000);\n(b) Issue a formal or informal reprimand;\n(c) Report misconduct to the licensing authority of any state;\n(d) Revoke or suspend the authority of the out -of-state principal broker or out-of-\nstate licensee to perform acts of real estate brokerage with respect to\ncommercial real estate;\n(e) Publish and maintain a public registry of any sanctions or penalties imposed\npursuant to this subsection; and\n(f) Report suspected violations of KRS Chapter 523 to the Commonwealth's\nattorney of the county in which the office of the commission is located.","path":["KRS Chapter 324"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31591","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:19Z","sha256":"ba12ac988c50a4579f665b95a51046979f9bbdb44c4436be2bc61dc4ab404e43","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324.237","next":"us-ky/krs-324.240"},"notice":"GroundRules: Original legal text.
