{"data":{"id":"us-ky/krs-324a.015","jurisdiction":"us-ky","citation":"KRS 324A.015","heading":"Real Property Appraisers Board -- Members -- Removal -- Seal --","body":"Compensation -- Duty -- Qualifications of certain employees.\n(1) There is hereby created an independent agency of state government to be known as\nthe Real Property Appra isers Board, which shall be attached to the Department of\nProfessional Licensing for administrative purposes. The board shall consist of seven\n(7) members, two (2) of whom shall be certified general real property appraisers,\ntwo (2) of whom shall be certif ied residential real property appraisers, one (1) of\nwhom shall represent the public and shall not be associated with or financially\ninterested in the practice of real property appraisals, and two (2) of whom shall be\nemployed in the lending industry. The board shall administer this chapter and may\npromulgate administrative regulations necessary to effectuate KRS 324A.010 to\n324A.100.\n(2) (a) The board members shall be appointed by the Governor. Not more than one\n(1) board member shall be from any one (1) c ounty within Kentucky.\nMembers shall be appointed by the Governor for staggered terms of three (3)\nyears. No person shall serve more than two (2) full consecutive terms.\n(b) Any member appointed to fill a vacancy occurring other than by expiration of\na term shall be appointed for the remainder of the unexpired term.\n(c) No more than four (4) members of the same political party shall serve on the\nboard at the same time.\n(3) The appraiser appointees to the board shall be certified and shall have engaged in\nthe appraisal of real property in Kentucky on a continuing basis for at least ten (10)\nyears.\n(4) A board member shall be automatically removed from the board and a vacancy\nshall occur when:\n(a) An appraiser member of the board ceases to be certified;\n(b) A consumer member of the board acquires a certification as an appraiser;\n(c) A lending industry member ceases to be employed in the lending industry;\n(d) A board member enters a plea of guil ty to, or has been found guilty of, a\nfelony and the time for appeal has passed or the judgment of conviction has\nbeen finally affirmed on appeal;\n(e) A board member ceases to be a bona fide resident of the Commonwealth of\nKentucky;\n(f) A board member disp lays incompetence, neglect of duty, or unprofessional\nconduct;\n(g) A board member fails to adhere to a duly adopted code of ethics of the board.\nFailure to adhere to this code shall be determined by official action of the\nboard; or\n(h) A board member misse s three (3) consecutive meetings or misses more than\ntwenty-five percent (25%) of the meetings held over the previous twelve (12)\nmonth period.\n(5) The board shall adopt a seal with the design it prescribes, by which it shall\nauthenticate its proceedings. Copies of all records and papers in the office of the\nboard, duly certified and authenticated by the seal of the board, shall be received in\nevidence in all courts equally and with like effect as the original. All records kept in\nthe office of the board un der the authority of this chapter shall be open to public\ninspection in accordance with KRS 61.820 to 61.884 and consistent with\nadministrative regulations promulgated by the board.\n(6) The Governor shall set the compensation of the members of the board, b ut voting\nmembers of the board shall be compensated no more than three hundred dollars\n($300) per day for official business, subject to an annual maximum of six thousand\ndollars ($6,000). Members shall be reimbursed for all expenses paid and incurred in\nthe discharge of official business consistent with the reimbursement policy for state\nemployees.\n(7) (a) The board shall ensure that those employed to investigate grievances filed\nwith the board or to conduct an appraisal review are state -certified appraisers\nwith:\n1. A minimum of ten (10) years of experience;\n2. A credential that is equal to or exceeds the credential held by the\nappraiser under investigation or appraisal review; and\n3. Demonstrated experience in appraising the type of property relevant to\nthe investigation or appraisal review.\n(b) Any investigation or appraisal review conducted without the experience\nrequired in paragraph (a)2. and 3. of this subsection may be challenged to the\nboard by the appraiser under investigation or review.","path":["KRS Chapter 324A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58025","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:20Z","sha256":"8ec866a8c247105baa21edb455717c7e4cd2aa3e1e45bab59e80892a6e396b7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324a.010","next":"us-ky/krs-324a.020"},"notice":"GroundRules: Original legal text.
