{"data":{"id":"us-ky/krs-324a.047","jurisdiction":"us-ky","citation":"KRS 324A.047","heading":"Inactive status for certificate or license -- Effect -- Reactivation.","body":"(1) (a) Upon written request, any certificate holder or licensee may request to place\nhis or her certificate or license in inactive status for a period not to exceed\nthree (3) years.\n(b) The written request shall be made by completing a signed and sworn affidavit\non a form approved by the board.\n(c) The board may require a fee in an amount to be determined by the board\nthrough an administrative regulation promulgated in  accordance with KRS\nChapter 13A for each change in status of the certificate holder or licensee.\n(d) A license issued to an individual as an associate real property appraiser shall\nnot be eligible for inactive status.\n(2) No inactive status certificate holder or licensee shall:\n(a) Assume or use any title, designation, or abbreviation likely to create the\nimpression that he or she holds a certificate or license issued by the board;\n(b) Describe or refer to any appraisal or evaluation of real property by th e term,\n\"state certified,\" \"state licensed,\" or words of substantially similar meaning; or\n(c) Prepare real property appraisals for federally related transactions which, under\nTitle XI of the Financial Institutions Reform, Recovery, and Enforcement Act\nof 1989, require the services of a state-certified or state-licensed appraiser.\n(3) To return to active status, a certificate holder or licensee shall:\n(a) Petition the board for reactivation of the certificate or license;\n(b) Pay the applicable renewal fee and roster fee required by this chapter; and\n(c) 1. Provide evidence of completion of the biennially required continuing\neducation hours, as established by the board and promulgated in\nadministrative regulations, if in inactive status for two (2) or more years;\nor\n2. a. Provide evidence of completion of at least half of the required\ncontinuing education hours, as established by the board and\npromulgated in administrative regulations, if in inactive status for\nless than two (2) years.\nb. If providing evidence of half of the required continuing education\nhours, once the certificate holder or licensee returns to active\nstatus the remaining continuing education hours shall be\ncompleted within six (6) months.\n(4) A certificate holde r or licensee who petitions to return to active status after an\ninactive period exceeding three (3) years shall be required to meet all the\nrequirements for original issuance of a license or certificate under this chapter.\n(5) Violation of subsection (2) o f this section shall be grounds for disciplinary action\nunder this chapter.","path":["KRS Chapter 324A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58030","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:20Z","sha256":"1b3a43ed139f5948881630b26d6c9b8d23c88705953c751f6f64ec6a3b881fa5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324a.045","next":"us-ky/krs-324a.050"},"notice":"GroundRules: Original legal text.
