{"data":{"id":"us-ky/krs-324a.158","jurisdiction":"us-ky","citation":"KRS 324A.158","heading":"Prohibitions against certain conduct by registrants.","body":"(1) An employee, director, officer, or agent of an appraisal management company or\nany other third party acting as a joint venture partner with or as an independent\ncontractor for an appraisal management company shall not improperly influence or\nattempt to imp roperly influence the development, reporting, result, or review of a\nreal property appraisal, including but not limited to the use of intimidation,\ncoercion, extortion, bribery, blackmail, threat of nonpayment or withholding\npayment for appraisal services, or threat of exclusion from future appraisal work.\n(2) The registrant shall not:\n(a) Request, allow, or require an appraiser to collect any portion of the fee\ncharged by the appraisal management company, including the appraisal fee,\nfrom a borrower, homeowner, or other third party;\n(b) Require an appraiser to provide the registrant with the appraiser's digital\nsignature or seal;\n(c) Alter, amend, or change an appraisal report submitted by a licensed or\ncertified appraiser, by the following or any other actions:\n1. Removing the appraiser's signature;\n2. Adding or removing information to or from the appraisal report; or\n3. Altering the final value opinion reported by an appraiser;\n(d) Remove an appraiser from an appraiser panel without prior written notice to\nthe appraiser. An appraiser may only be removed from an appraiser panel\nwith written notice for:\n1. A violation of the minimum USPAP standards or other applicable\nstatutes or admin istrative regulations resulting in a suspension or\nrevocation of the appraiser's license in Kentucky; or\n2. Other substandard or otherwise improper performance as may be\ndetermined by administrative regulations promulgated by the board;\n(e) Enter into cont racts or agreements with an appraiser for the performance of\nappraisal services unless the appraiser is licensed or certified in good standing\nwith the board;\n(f) Request that an appraiser provide an estimated, predetermined, or desired\nvaluation in an app raisal report or provide estimated values or comparable\nsales at any time before the appraiser completes an appraisal report;\n(g) Provide to an appraiser an anticipated, estimated, encouraged, or desired value\nfor a property or a proposed or target amount to be loaned or borrowed,\nexcept that a copy of the sales contract for purchase transactions may be\nprovided;\n(h) Commit an act or practice that impairs or attempts to impair an appraiser's\nindependence, objectivity, or impartiality; or\n(i) Have a direct o r indirect interest, financial or otherwise, in the property or\ntransaction involving the appraisal.\n(3) Subsection (1) of this section shall not prohibit an appraisal management company\nfrom requesting that an appraiser:\n(a) Provide additional information about the basis for a valuation;\n(b) Correct objective factual errors in an appraisal report; or\n(c) Provide further detail, substantiation, or explanation for the appraiser's value\nconclusion.","path":["KRS Chapter 324A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58045","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:20Z","sha256":"75435dce88b8d042859317a7e24b03133728cc21178875e0ac97eefbb7900bd1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324a.156","next":"us-ky/krs-324a.160"},"notice":"GroundRules: Original legal text.
