{"data":{"id":"us-ky/krs-324b.045","jurisdiction":"us-ky","citation":"KRS 324B.045","heading":"Division of Real Property Boards -- Permissible functions -- Duties of","body":"director and secretary.\n(1) (a) The Division of Real Property Boards is hereby created within the\nDepartment of Professional Licensing and shall include the:\n1. Kentucky Board of Home Inspectors, established under KRS 198B.704;\nand\n2. Board of Auctioneers, established under KRS 330.050.\n(b) The Division of Real Property Boards shall be managed by a director, who\nshall be appointed by the secretary of the Public Protect ion Cabinet with prior\nwritten approval of the Governor. The director shall be exempted from the\nclassified service.\n(c) The Division of Real Property Boards may:\n1. Provide appropriate attorneys, personnel staffing, and administrative\nsupport to the real property boards identified in paragraph (a) of this\nsubsection;\n2. Establish and maintain an office, meeting space, office supplies,\nfurniture, storage space, and any other supplies that are necessary to\ncarry out the duties of the Division of Real Propert y Boards and the real\nproperty boards identified in paragraph (a) of this subsection;\n3. Make available for public inspection all decisions, opinions, and\ninterpretations formulated or used by the division and the real property\nboards identified in paragra ph (a) of this subsection in discharging their\nfunctions;\n4. Publicize the functions and purposes of the Division of Real Property\nBoards and the real property boards identified in paragraph (a) of this\nsubsection;\n5. Employ administrative coordinators who shall carry out the\nadministrative functions and day -to-day operations of the real property\nboards identified in paragraph (a) of this subsection. The maximum\nnumber of administrative coordinators shall be one (1) for each real\nproperty board. These administrative coordinators shall be exempted\nfrom the classified service; and\n6. Enter into agreements with any state agency, political subdivision of the\nstate, postsecondary education institution, or other person or entity to\nassist with implementation of the duties and responsibilities of the\nDivision of Real Propert y Boards or, upon request, the real property\nboards identified in paragraph (a) of this subsection.\n(2) The director of the Division of Real Property Boards shall:\n(a) Provide oversight of the Division of Real Property Boards;\n(b) Review and provide feedba ck on any administrative regulation proposed by\nany of the boards within the Division of Real Property Boards prior to the\npromulgation of the administrative regulation;\n(c) Review and provide feedback on the budgets and expenditures of the boards\nwithin the Division of Real Property Boards;\n(d) Submit written recommendations to the secretary of the Public Protection\nCabinet concerning sufficient staffing needs and relevant experience\nnecessary to assist in carrying out the mission and function of the Divis ion of\nReal Property Boards;\n(e) Pursuant to KRS 13B.120(7), automatically hear and issue a final order\nregarding any decision of a real property board that would otherwise be\nsubject to appeal. An aggrieved party may appeal a final order of the director\npursuant to KRS Chapter 13B within thirty (30) days after the issuance of the\norder to the Circuit Court of the county where the party has his or her\nprincipal place of business or where the party resides;\n(f) Make available for public inspection all decisi ons, opinions, and\ninterpretations formulated or used by the director in discharging his or her\nfunctions;\n(g) Carry out the applicable policy and program directives of the department;\n(h) Prepare annual reports on the director's activities;\n(i) Delegate any power to employees and contractors as needed;\n(j) Have a minimum of seven (7) years of experience in the real estate industry\nwithin the last fifteen (15) years; and\n(k) Perform all other duties assigned by law.\n(3) The secretary of the Public Protection Cabinet shall:\n(a) Consider the staffing recommendations and requests submitted by the director\nof the Division of Real Property Boards; and\n(b) Provide the Division of Real Property Boards with documentation showing\nthe income and expenditures of all license fees.","path":["KRS Chapter 324B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58034","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:20Z","sha256":"0e3e07d8b5a1b463b1cf7429e40a7a7ed12bb418ea7b22ff8f63f9af0c70a5c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-324b.040","next":"us-ky/krs-324b.050"},"notice":"GroundRules: Original legal text.
