{"data":{"id":"us-ky/krs-325.431","jurisdiction":"us-ky","citation":"KRS 325.431","heading":"Evidentiary privilege for sponsoring organization materials -- Testimonial","body":"privilege -- Exceptions.\n(1) The proceedings, records, and workpapers of the sponsoring organization shall be\nprivileged and not subject to discovery, subpoena, or other  means of legal process,\nor introduction into evidence in any civil action, arbitration, administrative\nproceeding, or state accountancy board proceeding. No member of the sponsoring\norganization or person involved in the peer review process shall testify in any civil\naction, arbitration, administrative proceeding, or state accountancy board\nproceeding as to any matter produced, presented, disclosed, or discussed during or\nin connection with the peer review process, or as to any finding, recommendation,\nevaluation, opinion, or other action of the committee.\n(2) Information, documents, or records that are publicly available shall not be immune\nfrom discovery or use in any civil action, arbitration, administrative proceeding, or\nstate accountancy board proceed ing merely because they were presented or\nconsidered in connection with the peer review process.\n(3) The privilege created in subsection (1) of this section shall not apply to:\n(a) Materials prepared in connection with a particular engagement merely because\nthey happen to subsequently be presented or considered as part of the peer of\nreview process.\n(b) Disputes between the sponsoring organization and persons or firms subject to\na peer review arising from the performance of the peer review.\n(c) Correspondence and reports of the peer review program obtained by the board\nfrom a licensee seeking renewal or an individual or firm seeking to become\nlicensed.\n(d) A statement obtained by the board from sponsoring organization to determine\nif a licensee seeking renew al or an individual or firm seeking to become\nlicensed is enrolled in or is not enrolled in a peer review program.","path":["KRS Chapter 325"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47507","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:21Z","sha256":"9dc5a8bfdad7fca33209b7a5fb7e8ba0f41c4cc86266e852441268a95449ef8d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-325.430","next":"us-ky/krs-325.440"},"notice":"GroundRules: Original legal text.
