{"data":{"id":"us-ky/krs-325.440","jurisdiction":"us-ky","citation":"KRS 325.440","heading":"Confidentiality of information obtained in practice.","body":"(1) A licensee shall not, without the consent of his client, disclose any confidential\ninformation pertaining to his client obtained in the course of performing\nprofessional services.\n(2) This section does not:\n(a) Relieve a licensee of any obligations under the rules of professional conduct;\n(b) Affect in any way a licensee's obligation to comply with a validly issued\nsubpoena or summons enforceable by order of a court;\n(c) Prohibit disclosures in the course of a peer review of a licensee's professional\nservices; or\n(d) Preclude a licensee from responding to any inquiry made by the board or any\ninvestigative or disciplinary body established by law or formally recognized\nby the board.\n(3) Members of the board and professional practice reviewers shall not d isclose any\nconfidential client information which comes to their attention from licensees in\ndisciplinary proceedings or otherwise in carrying out their responsibilities, except\nthat they may furnish such information to an investigative or disciplinary bod y of\nthe kind referred to above.","path":["KRS Chapter 325"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47508","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:21Z","sha256":"d22174d9665e04fc00527e318c36d4fde1de5094a25a414496b3d4f873a530bc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-325.431","next":"us-ky/krs-325.445"},"notice":"GroundRules: Original legal text.
