{"data":{"id":"us-ky/krs-326.020","jurisdiction":"us-ky","citation":"KRS 326.020","heading":"Kentucky Board of Ophthalmic Dispensers -- Membership -- Appointment","body":"-- Qualifications -- Terms -- Powers.\n(1) There is hereby created a board of ophthalmic dispensers to be known as the\n\"Kentucky Board of Ophthalmic Dispensers.\" It shall consist of five (5) members to\nbe appointed by the Governor, one (1) member of which shall be a licensed medical\nphysician or osteopath experienced in the treatment and examination of eyes and\none (1) member of which shall be a licensed optometrist. Two (2) members sh all be\nlicensed ophthalmic dispensers. One (1) member shall be a citizen at large who is\nnot associated with or financially interested in the practice or business regulated.\nThey shall not pass upon their own qualifications. The board shall elect one (1) o f\nits members chairman and one (1) member secretary -treasurer. These officers shall\nserve at the pleasure of the board.\n(2) Members shall serve for a period of four (4) years from the date of their\nappointment and qualification. At the expiration of the te rm of office of any\nmember, the Governor shall appoint a successor for a term of four (4) years.\n(3) (a) The board may promulgate administrative regulations to carry out the\npurposes and provisions of this chapter, including the licensing of apprentice\nophthalmic dispensers and the adoption of a program for continuing education\nfor all licensees.\n(b) No licensee shall be permitted to renew his or her license, unless the\nminimum annual continuing education requirements have been completed. No\nprogram for con tinuing education shall contain, as a prerequisite for license\nrenewal, a requirement for more than a total of six (6) credit hours per year for\nophthalmic dispenser licensees, or four (4) credit hours per year for apprentice\nophthalmic dispenser licensees.\n(4) Board members shall receive fifty dollars ($50) per day for attending board\nmeetings. Board members shall also be reimbursed for reasonable and necessary\nexpenses incurred in the performance of their duties.\n(5) The board may:\n(a) Revoke, suspend, or refuse to issue or renew licenses; impose probationary or\nsupervisory conditions upon licensee; or issue written reprimands to licensees,\nin accordance with KRS 326.090;\n(b) Impose administrative fines in accordance with KRS 326.100; or\n(c) Take any other action or combination of actions regarding licenses, licensees,\nor apprenticeships authorized by this chapter.\n(6) For the purpose of enforcing the provisions of this chapter, the board may\nadminister oaths, receive evidence, interview persons, issue subp oenas, and require\nthe production of books, papers, documents, or other evidence.\n(7) The board may seek injunctive relief in Franklin Circuit Court to enjoin violation of\nKRS 326.030.","path":["KRS Chapter 326"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31698","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:21Z","sha256":"5f5ed6ceb5bfc2e0b1a0fafb5038121e855d282ffb489145a9afe76bf0d52a5f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-326.010","next":"us-ky/krs-326.030"},"notice":"GroundRules: Original legal text.
