{"data":{"id":"us-ky/krs-329.010","jurisdiction":"us-ky","citation":"KRS 329.010","heading":"Definitions.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Detection of deception examiner,\" referred to in this chapter as \"examiner,\" means\nany person, other than a trainee, who uses any device or instrument to test or\nquestion individuals for the purpose of detecting deception. Before a person may be\nlicensed as an examiner, he or she must have at least one (1) year's experience in\ndetection of deception. Before an examiner may supervise a trainee, he or she must\nhave at least two (2) years' experience in detection of deception;\n(2) \"Trainee\" means any person who has successfully completed a polygraph\nexaminer's course at a polygraph examiner's school approved by the cabinet, but\nwho has not been awarded the final certificate of proficiency or g raduate certificate\nfrom the school, or any person, not a licensed examiner, who administers detection\nof deception examinations under the direct, personal supervision and control of a\nlicensed examiner who is licensed by this state. No examiner may have m ore than\ntwo (2) trainees under his or her supervision and control at any one (1) time;\n(3) \"Person\" means any natural person, partnership, association, corporation, or trust;\n(4) \"Cabinet\" means the Justice and Public Safety Cabinet of the Commonwealth of\nKentucky;\n(5) \"Secretary\" means the secretary of the Justice and Public Safety Cabinet of the\nCommonwealth of Kentucky;\n(6) \"Polygraph\" means an instrument which records permanently and simultaneously a\nsubject's cardiovascular and respiratory patterns an d other physiological changes\npertinent to the detection of deception; and\n(7) \"Polygraph examiner\" means the same as detection of deception examiner.","path":["KRS Chapter 329"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31738","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:21Z","sha256":"ff7bef865e2f57f62b3be2b436e898f6f70126f713e290e29ab98cf69b18148b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-328.991","next":"us-ky/krs-329.020"},"notice":"GroundRules: Original legal text.
