{"data":{"id":"us-ky/krs-329.030","jurisdiction":"us-ky","citation":"KRS 329.030","heading":"License required to administer detection of deception examination --","body":"Application -- Fingerprint data -- Qualifications -- Investigations -- Internship\n-- Examination -- Administrative regulations to ensure adequate standards.\n(1) No person shall admin ister a detection of deception examination, as set forth in\nKRS 329.010, or any imitation thereof, without first securing a trainee's license or\nan examiner's license. Each application for a trainee's license shall be made to the\ncabinet within ten (10) da ys of the commencement of the trainee's internship, and\nsaid application shall contain such information as may be reasonably required by the\ncabinet. Each application for a trainee license or a renewal or extension shall be\naccompanied by a fee of twenty -five dollars ($25), which is nonrefundable. Each\napplication for an examiner's license shall be made to the cabinet in writing on\nforms provided by the cabinet and shall contain such information as may be\nrequired by the cabinet to determine the eligibility of the applicant. Each application\nfor an examiner's license shall be accompanied by a fee of fifty dollars ($50), which\nis nonrefundable.\n(2) Each applicant for an examiner's license shall submit his or her fingerprints to the\ncabinet. The cabinet is authorized to exchange fingerprint data with the Department\nof Kentucky State Police and the Federal Bureau of Investigation in order to\nconduct a criminal history background check of the applicant. Each applicant shall\nalso submit a sworn affidavit that said applicant:\n(a) Is a citizen of the United States;\n(b) Is at least eighteen (18) years of age;\n(c) Has administered detection of deception examinations for a period of at least\none (1) year using the instrumentation prescribed in KRS 329.020;\n(d) Has compl eted a course of formal training in detection of deception in an\ninstitution accepted by the cabinet;\n(e) Has not been convicted of a misdemeanor involving moral turpitude or a\nfelony, or who has not been released or discharged under other than honorable\nconditions from any of the Armed Services of the United States, or any branch\nof the state, city or federal government; and\n(f) Any other information required by the cabinet to determine the examiner's\ncompetency to obtain a license to practice in this state.\n(3) Upon receipt of an application for a trainee's license or for an examiner's license,\nthe secretary shall investigate each application, and no license will be issued until\nsaid investigation is complete.\n(4) The cabinet shall establish such reasonabl e rules and regulations for the trainee\nduring his internship as may be reasonably necessary for the purpose of insuring\nthat the trainee meets adequate professional standards established by the cabinet.\n(5) The cabinet may require applicants for an examiner's license to pass an examination\nwhich shall be confined to such knowledge, practical ability, and skill as is essential\nfor performing the duties of a detection of deception examiner. The cabinet shall\npromulgate administrative regulations for conducting examinations and shall define\nthe standards to be acquired to constitute passing the examination.\n(6) The cabinet shall promulgate administrative regulations for the purpose of insuring\nthat the examiner maintain adequate professional standards establis hed by the\ncabinet.","path":["KRS Chapter 329"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:21Z","sha256":"8ae99df71cbd0973c64156106ac52092f934eda720883fb1881e380c60dc6fd7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-329.020","next":"us-ky/krs-329.040"},"notice":"GroundRules: Original legal text.
