{"data":{"id":"us-ky/krs-329a.025","jurisdiction":"us-ky","citation":"KRS 329A.025","heading":"Duties and powers of board.","body":"(1) The  board shall administer and enforce the provisions of KRS  329A.010 to\n329A.090 and shall evaluate the qualifications of applicants for licensure and\nissue licenses.\n(2) The board shall:\n(a) Implement  the provisions of KRS  329A.010 to 329A.090 through the\npromulgation of administrative regulations in accordance  with the\nprovisions of KRS Chapter 13A;\n(b) Promulgate administrative regulations to establish fees which shall not\nexceed the amounts necessary to generate sufficient funds to effectively\ncarry out and enforce the provisions of KRS 329A.010 to 329A.090;\n(c) Promulgate  by  administrative regulation an  examination to  be\nadministered at least twice annually to license applicants. The\nexamination shall be designed to measure knowledge and competence in\nprivate investigating, including but not limited to the following subject\nareas:\n1. Federal and state constitutional principles;\n2. Court decisions related to activities which could result in liability for\nthe invasion of privacy or other activities;\n3. Eavesdropping and related offenses, assault and related offenses,\nsearch and seizure laws, and laws regarding unlawful access to a\ncomputer;\n4. General weapons use and concealed weapons laws;\n5. Additional state criminal laws and  related procedures that are\nrelevant to the practice of private investigating; and\n6. Additional subject areas as determined by the board; and\n(d) Promulgate by administrative regulation a code of professional practice\nand conduct that shall be based upon generally recognized principles of\nprofessional ethical conduct and be binding upon all licensees.\n(3) The board may:\n(a) Contract with the Department of Professional Licensing within the Public\nProtection Cabinet for the provision of administrative services;\n(b) Employ  any persons it deems  necessary to carry on the work of the\nboard. The board may define their duties and fix their compensation;\n(c) Develop  or sponsor at least six (6) hours of continuing professional\neducation annually;\n(d) Approve and certify a forty (40) hour training class covering the subject\nareas of the licensing examination;\n(e) Renew  licenses and require continuing professional education as a\ncondition for renewal;\n(f) Waive  the examination requirement for any applicant licensed in a\nreciprocal state as prescribed in subsection (3)(m) of this section, who is\nlicensed in good  standing in that state and meets all of the other\nrequirements of KRS 329A.035;\n(g) Suspend  or revoke licenses, impose  supervisory or probationary\nconditions upon licensees, impose administrative disciplinary fines, or\nissue written admonishments or reprimands, or any combination thereof;\n(h) Issue subpoenas, examine witnesses, pay appropriate witness fees,\nadminister oaths, and investigate allegations of practices violating the\nprovisions of KRS 329A.010 to 329A.090;\n(i) Conduct hearings pursuant to KRS  Chapter 13B and keep records and\nminutes necessary to carry out the board's functions;\n(j) Organize itself into two (2) panels to separate the functions of inquiry and\nhearings. Each panel shall have the power to act as either an inquiry or\nhearing panel. No member  serving on the inquiry panel shall serve on the\nhearing panel for any one (1) particular case. Any final decision of the\nhearing panel shall be considered as the final decision of the board and\nthe hearing panel may exercise all powers granted to the board pursuant\nto KRS Chapter 13B;\n(k) Utilize mediation as a technique to resolve disciplinary matters;\n(l) Seek injunctive relief in the Circuit Court of the county where the alleged\nunlawful practice occurred to stop the unlawful practice of private\ninvestigating by unlicensed persons or companies; and\n(m) Negotiate and enter into reciprocal agreements with appropriate officials\nin other states to permit licensed investigation companies and private\ninvestigators who meet or exceed the qualifications established in KRS\n329A.010  to 329A.090 to operate across state lines under mutually\nacceptable terms.","path":["KRS Chapter 329A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45677","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"3319edb10d32e6caa3ceb421e5dc84b09b87c38f97d4047e1dd1d0b991a5d22a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-329a.020","next":"us-ky/krs-329a.030"},"notice":"GroundRules: Original legal text.
