{"data":{"id":"us-ky/krs-329a.035","jurisdiction":"us-ky","citation":"KRS 329A.035","heading":"Applications for licenses -- Requirements -- Confidentiality.","body":"(1) An application for a private investigator license shall be filed with the board on the\nprescribed form.\n(a) The application shall include the following information regarding the\napplicant:\n1. Full name and address;\n2. Date and place of birth;\n3. Social Security number;\n4. All residences during the past five (5) years;\n5. All employment or occupations engaged in during the past five (5)\nyears;\n6. Three (3) sets of classifiable fingerprints; and\n7. Any other information as the board may reasonably require by\nadministrative regulation.\n(b) The application shall be subscribed and sworn to by the applicant.\n(c) If the applicant intends to conduct fire or arson investigations, proof of current\nnational certification from the National Association of Fire Investigat ors or\nthe International Association of Arson Investigators shall be filed with the\nboard in addition to the information required in paragraph (a) of this\nsubsection.\n(2) An application for an investigating company license shall be filed with the board on\nthe prescribed form.\n(a) The application shall include:\n1. The information required in subsection (1)(a) of this section for:\na. The owner, if the company is a sole proprietorship;\nb. Each partner, if the company is a partnership; or\nc. The qualifying agent, if the company is a corporation;\n2. The name under which the company intends to do business;\n3. The address of the principal place of business and any branch offices of\nthe company within this state; and\n4. Other information as the board may reasonably require by administrative\nregulation.\n(b) If the company is a corporation, the following information is also required:\n1. The correct legal name of the corporation;\n2. The state and date of incorporation;\n3. The date the corporation qualified to do business in this state;\n4. The address of the corporate headquarters, if located outside of this\nstate;\n5. The names of two (2) principal corporate officers other than the\nqualifying agent, their business addresses, residence addresses, and the\noffice held by each in the corporation; and\n6. The identity and license number of all private investigators employed by\nor affiliated with the company.\n(c) The application shall be subscribed and sworn to by:\n1. The owner, if the applicant is a sole proprietorship;\n2. Each partner, if the applicant is a partnership; or\n3. The qualifying agent, if the applicant is a corporation.\n(3) Each applicant for an individual license or owner, partner, or qualifying agent for a\ncompany license shall:\n(a) Be at least twenty-one (21) years of age;\n(b) Be a citizen of the United States or a resident alien;\n(c) Have a high school education or its equivalent;\n(d) Not receive a license until the earlier of:\n1. The expiration of ten (10) years from the applicant's release fro m a\nsentence imposed by any state or territory of the United States or the\nfederal government for the commission of a felony, including a sentence\nof confinement or time served on probation, parole, or other form of\nconditional release or discharge; or\n2. The date the applicant received a restoration of the applicant's civil\nrights;\n(e) Not have been convicted of a misdemeanor involving moral turpitude or for\nwhich dishonesty is a necessary element within the previous five (5) years;\n(f) Not have been dishonorably discharged from any branch of the Armed Forces\nof the United States;\n(g) Not have had his or her certification as a peace officer revoked in this or\nanother state;\n(h) Not have been declared by any court of competent jurisdiction  to be\nincompetent by reason of mental defect or disease unless a court of competent\njurisdiction has since declared the applicant to be competent;\n(i) Not have been voluntarily or involuntarily committed to a facility or\noutpatient program for the abuse o f a controlled substance or been convicted\nof a misdemeanor violation of KRS Chapter 218A or similar laws of any other\nstate relating to controlled substances within the three (3) year period\nimmediately preceding the date on which the application is submitted;\n(j) Not chronically and habitually use alcoholic beverages as evidenced by:\n1. The applicant having two (2) or more convictions for violating KRS\n189A.010 within the three (3) year period immediately preceding the\ndate on which the application is submitted; or\n2. The applicant having been committed as an alcoholic pursuant to KRS\nChapter 222, or similar laws of any other state, within the three (3) year\nperiod immediately preceding the date on which the application is\nsubmitted;\n(k) Not chronically and habitually use alcoholic beverages or drugs to the extent\nthat his or her normal faculties are impaired;\n(l) Be of good moral character;\n(m) Pass an examination administered by the board in accordance with KRS\n329A.025(2)(c); and\n(n) Submit proof of coverage which meets the following requirements:\n1. Is written by an insurance company which is lawfully engaged to\nprovide insurance coverage in Kentucky;\n2. Provides for a combined single-limit policy in the amount of at least two\nhundred fifty thousand dollars ($250,000); and\n3. Insures for liability all of the applicant's employees while acting in the\ncourse of their employment.\nPrivate investigators who limit their practice exclusively to working under the\nsupervision and as employees of an attorney who is licensed to practice law in\nthis state are exempted from the requirement of this paragraph.\n(4) The board shall maintain the confidentiality of information relating to the licensee\nor applicant, except that the board may provide this information to local , state, or\nfederal law enforcement agencies.\n(5) Upon inquiry by any individual or entity, the board or the board's administrative\nstaff shall provide or confirm the license status of any private investigator or private\ninvestigating company.","path":["KRS Chapter 329A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31763","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"19a5a948c077bdd1235ea55740a2b12d7170830e9d63ca36d1ea732e604f726d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-329a.030","next":"us-ky/krs-329a.040"},"notice":"GroundRules: Original legal text.
