{"data":{"id":"us-ky/krs-329a.065","jurisdiction":"us-ky","citation":"KRS 329A.065","heading":"Disciplinary actions -- Civil penalty -- Permanent file -- Assurance of","body":"voluntary compliance -- Appeal.\n(1) The  board may  refuse to issue a license, or suspend, revoke, impose\nprobationary conditions, impose  an  administrative fine, issue a  written\nreprimand, or any combination thereof regarding any licensee upon proof that\nthe licensee or applicant has:\n(a) Violated any  provision of KRS  329A.010  to 329A.090  or  any\nadministrative regulation promulgated by the board;\n(b) Knowingly and willfully made  a material misstatement in connection with\nan application for license or renewal;\n(c) Been convicted of a felony, if in accordance with KRS Chapter 335B;\n(d) Practiced fraud, deceit, or misrepresentation;\n(e) Committed  any act that would have been cause for refusal to issue the\nlicense had it existed and been known  to the board at the time of\nissuance;\n(f) Been incompetent or negligent in the practice of private investigating; or\n(g) Violated the code of ethics promulgated by administrative regulation by\nthe board.\n(2) In addition to or in lieu of any other lawful disciplinary action under this section,\nthe board may  assess a civil penalty not exceeding two thousand dollars\n($2,000).\n(3) When  the board issues a written reprimand to the licensee a copy of the\nreprimand shall be placed in the permanent file of the licensee. The licensee\nshall have the right to submit a response within thirty (30) days of its receipt\nand to have that response filed in the permanent file.\n(4) At any time during the investigative or hearing processes, the board may\naccept  an  assurance of voluntary compliance from the licensee if the\nassurance effectively deals with the complaint.\n(5) The  board may  reconsider, modify, or reverse its probation, suspension, or\nother disciplinary action.\n(6) Any party aggrieved by a disciplinary action of the board may bring an action in\nFranklin Circuit Court pursuant to the provisions of KRS Chapter 13B.\n(7) A license shall be subject to expiration and renewal during any period in which\nthe license is suspended.","path":["KRS Chapter 329A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46835","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"2dafa20b0cc20a19798dd383b37a6146f03b665d7a149f74119fde8fcb65d5e9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-329a.060","next":"us-ky/krs-329a.070"},"notice":"GroundRules: Original legal text.
