{"data":{"id":"us-ky/krs-329a.070","jurisdiction":"us-ky","citation":"KRS 329A.070","heading":"Scope of KRS  329A.010 to 329A.090.","body":"The provisions of KRS 329A.010 to 329A.090 do not apply to:\n(1) An  officer or employee of the United States, this state, another state, or any\npolitical subdivision thereof, performing his or her official duties within the\ncourse and scope of his or her employment;\n(2) A public accountant, certified public accountant, or the bona fide employee of\neither, performing duties within the scope of public accountancy;\n(3) A  person engaged  exclusively in the business of obtaining and furnishing\ninformation regarding the financial rating or standing and credit of persons;\n(4) An  attorney-at-law, or an attorney's bona fide employee, performing duties\nwithin the scope of the practice of law or authorized agent with duties limited to\ndocument and record retrieval or witness interviews;\n(5) An insurance company, licensed insurance agent, staff or independent adjuster\nif authorized to do business in Kentucky, or an individual employed by an\ninsurance company  or licensed insurance agent to investigate suspected\nfraudulent insurance claims, but who  does not adjust losses or determine\nclaims payments, performing investigative duties limited to matters strictly\npertaining to an insurance transaction;\n(6) A person engaged in compiling genealogical information, or otherwise tracing\nlineage or ancestry, by  primarily utilizing public records and  historical\ninformation or databases;\n(7) A private business employee conducting investigations relating to the company\nentity by which he or she is employed;\n(8) An  individual obtaining information or conducting investigations on his or her\nown  behalf;\n(9) An employee of a private investigator or a private investigating firm who works\nunder the direction of the private investigator or the private investigating firm for\nless than two hundred forty (240) hours per year. The board shall promulgate\nadministrative regulations to establish a method of verification of the number of\nhours worked;\n(10) A  professional engineer, a professional land surveyor, or a professional\nengineer's or professional land surveyor's bona fide employee, performing\nduties within the scope of practice of engineering or land surveying; or\n(11) A secured creditor, or person acting on behalf of a secured creditor, engaged\nin the repossession of the creditor's collateral pursuant to KRS 355.9-609.","path":["KRS Chapter 329A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45813","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"fbc70c5f4676490d8fd48199f210bb9aaee76376094a3bffdb06d7eeb4cea8fe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-329a.065","next":"us-ky/krs-329a.075"},"notice":"GroundRules: Original legal text.
