{"data":{"id":"us-ky/krs-330.030","jurisdiction":"us-ky","citation":"KRS 330.030","heading":"Auctioneer's license required -- When auction house operator's license","body":"required -- When escrow account required.\n(1) It is unlawful for any person to advertise or act as an auctioneer or apprentice\nauctioneer within the Commonwealth, or adverti se or act as an auctioneer or\napprentice auctioneer of real or personal property located within the\nCommonwealth, without a license issued by the board.\n(2) It is unlawful for any person to advertise or act as a limited livestock auctioneer\nwithin the Commonwealth without a license issued by the board.\n(3) (a) It is unlawful for any person to advertise or act as an auction house operator\nwithin the Commonwealth without a license issued by the board.\n(b) An auction house operator shall be a licensed auctione er or apprentice\nauctioneer if he or she acts as an auctioneer or apprentice auctioneer. If\nlicensed as an auctioneer, an auction house operator license shall not be\nrequired.\n(c) If an auction house operator conducts and operates more than one (1) auction\nhouse, a license shall be issued for each location, and the initial and renewal\nfees shall be applicable.\n(d) This subsection applies to each co-owner or manager of an auction house who\nactively participates in the operation of the auction house, but who is not an\nauctioneer.\n(4) (a) Each licensed principal auctioneer or auction house operator who takes\npossession of money for another in relation to an auction shall maintain at\nleast one (1) escrow account.\n(b) If a licensee already maintains an escrow acc ount due to licensure pursuant to\nKRS Chapter 198B, 324, or 324A, the licensee shall not be required to\nmaintain a second, separate escrow account.","path":["KRS Chapter 330"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48927","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"1ce794234a93df31306eff5f91b65e70837378e24786f1f252d2ac730e6ed826","source_id":"us-ky","stale":false,"prev":"us-ky/krs-330.020","next":"us-ky/krs-330.032"},"notice":"GroundRules: Original legal text.
