{"data":{"id":"us-ky/krs-330.040","jurisdiction":"us-ky","citation":"KRS 330.040","heading":"Exceptions to KRS 330.030.","body":"(1) KRS 330.030 shall not apply to:\n(a) An auction conducted by or under the direction of any public authority or\npursuant to any judicial order or decree, or to any sale required by law to be at\nauction;\n(b) An auction of any real or personal property conducted exclusively by an\nindividual who personally owns such real or personal property and who did\nnot acquire such real or personal property for resale. This paragraph is\napplicable only to individuals. It does not apply to any other \"person\" as\ndefined in KRS 330.020, nor does it apply to any officer, director, or\nemployee thereof when engaged in any duties associated with those capacities.\n(c) Any person who calls bids at the sale of livestock owned and offered at\nauction by 4 -H Clubs or FFA Clubs or club members, or by any university\noperated by the Commonwealth of Kentucky;\n(d) An auction conducted by or on behalf of any political party, church, or\ncharitable organization, corporation, or association if:\n1. The individual conducting the sale receives no compensation and does\nnot, by advertising or otherwise, present himself or herself as a licensed\nauctioneer;\n2. All real or personal property is donated and not consigned; and\n3. One hundred percent (100%) of the net proceeds of the auction are\ndonated to the political party, church, or charita ble organization,\ncorporation, or association; or\n(e) A student who:\n1. Is calling bids for a maximum of twenty (20) items or lots of personal\nproperty during a twenty-four (24) hour period at an auction;\n2. Is under the direct supervision of a person who is both the student's\ninstructor from a board -approved auction education provider and a\nlicensed auctioneer; and\n3. Receives no compensation and does not, by advertising or otherwise,\npresent himself or herself as being a licensed auctioneer.\nThe student and the supervising auctioneer instructor may both be liable for\nthe student's auction-related activities.\n(2) Notwithstanding the provisions of this section, a licensee shall not be exempt from\nany provisions of this chapter in connection with or by reason of his participation in\nany sale excepted under this section.","path":["KRS Chapter 330"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31781","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"b61cde94c01e19b27290b6b996767e50fadf35d316eb784e00b8e39d8c9a7137","source_id":"us-ky","stale":false,"prev":"us-ky/krs-330.035","next":"us-ky/krs-330.050"},"notice":"GroundRules: Original legal text.
