{"data":{"id":"us-ky/krs-330.060","jurisdiction":"us-ky","citation":"KRS 330.060","heading":"Requirements for licensure -- Examination, fee, exception -- Service of","body":"process.\n(1) (a) Every applicant for licensure shall be at least eighteen (18) years of age, show\nproof of a high school diploma or equivalent, and, within the preceding fi ve\n(5) years, shall not have committed any act that constitutes grounds for license\nsuspension or revocation under this chapter.\n(b) The board may waive the high school diploma or equivalent requirement if the\napplicant demonstrates sufficient life experie nce and competency by affidavit\nor other evidence as required by the board.\n(c) Any license issued pursuant to this chapter shall be granted only to a person\nfound to be of good repute, trustworthy, and competent to transact the\nbusiness for which the lice nse was granted in a manner requisite to\nsafeguarding the interest of the public.\n(d) Effective July 1, 2015, an applicant for an apprentice auctioneer license or\nauction house operator's license shall have successfully completed at least\ntwelve (12) hours  of approved classroom instruction, consisting of the core\ncourse and six (6) additional hours as prescribed by the board, from a board -\napproved auction education provider.\n(e) The board may waive the twelve (12) hours of approved classroom instruction\nrequirement if the applicant demonstrates sufficient previous auction\nexperience and competency by affidavit or other evidence as required by the\nboard.\n(2) The board is authorized to require information from every applicant to determine\nthe applicant's honesty and truthfulness.\n(3) (a) Every applicant shall successfully complete an examination, conducted by the\nboard or its authorized representative. Every application for examination shall\nbe submitted on board -prepared forms, and each applicant shall furnish\npertinent background data as outlined on the forms.\n(b) To defray the cost of administration of the examination, the board shall\nrequire each applicant to remit an examination fee established by\nadministrative regulations promulgated by the board in accor dance with KRS\nChapter 13A.\n(c) Examination fees shall be nonrefundable.\n(d) If the applicant is unable to attend the scheduled exam, the examination fee\nshall be deferred to the next scheduled administration of the examination.\n(e) Upon successful complet ion of the examination, the applicant shall apply for\ninitial licensure within forty -five (45) days of receiving notice of successfully\ncompleting the examination.\n(f) The examination shall be of the scope and wording sufficient in the judgment\nof the boar d to establish the competency of the applicant to act as an\nauctioneer or other licensee regulated by the board.\n(4) If a license has been revoked, suspended, or is allowed to expire without renewal,\nthe board may requ ire the applicant to pass the written examination or complete\nsome form of board-approved auction education before a license may be issued.\n(5) If a license has not been renewed within six (6) months of the expiration date, the\nboard shall require a person to successfully complete the written examination before\na license is issued.\n(6) In addition, every nonresident applicant shall file an irrevocable consent that actions\nmay be commenced against the applicant in any court of competent jurisdiction in\nthe C ommonwealth of Kentucky, by the service of any summons, process, or\npleadings authorized by law on the authorized representative of the board. The\nconsent shall stipulate and agree that the service of any summons, process, or\npleadings on the authorized representative shall be taken and held in all courts to be\nas valid and binding as if actual service had been made upon the applicant in\nKentucky. In case any summons, process, or pleadings are served upon the\nauthorized representative of the board, it shall  be by duplicate copies, one (1) of\nwhich shall be retained in the office of the board, and the other immediately\nforwarded by certified mail, return receipt requested, to the last known business\naddress of the applicant against whom the summons, process, or pleadings are\ndirected.","path":["KRS Chapter 330"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48928","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"27bd941ec1f757141de8f6349718ff7c8055b219eb868b7d3f36be4bf321ca8d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-330.050","next":"us-ky/krs-330.070"},"notice":"GroundRules: Original legal text.
