{"data":{"id":"us-ky/krs-330.070","jurisdiction":"us-ky","citation":"KRS 330.070","heading":"Apprentice auctioneer requirements -- Issuance of license -- Fees --","body":"Continuing education requirement -- Pocket license -- Duty of auctioneer upon\ntermination of apprentice employment -- Placement of licenses in escrow --\nNotice of change of address -- Continuing education.\n(1) An apprentice auctioneer applying for an auctioneer license shall, subject to the\nprovisions of KRS 330.060:\n(a) Possess a current Kentucky apprentice auctioneer license;\n(b) Serve an apprenticeship for a period o f one (1) year as an apprentice\nauctioneer in Kentucky;\n(c) Submit a statement to the board, signed by the principal auctioneer, verifying\nthat the applicant has actively and materially participated in at least ten (10)\nauctions prior to application; and\n(d) Successfully complete at least eighty (80) hours of approved classroom\ninstruction from a board-approved auction education provider. The board may\nwaive the eighty (80) hours of approved classroom instruction requirement if\nthe applicant demonstrates su fficient previous auction experience and\ncompetency by affidavit or other evidence as required by the board.\n(2) An apprentice auctioneer with an original license issued prior to June 30, 2010, or\nafter July 1, 2015, shall be required to successfully compl ete the auctioneer\nexamination.\n(3) If an applicant for an auctioneer license resides in a state which does not have a\ncurrent reciprocity agreement with the board, the board may waive the eighty (80)\nhour education requirement or the apprenticeship requir ement, or both, if the\napplicant demonstrates sufficient previous auction experience and competency by\naffidavit or by other evidence as required by the board.\n(4) An applicant for an auctioneer license who has previously held an auctioneer\nlicense which h as been revoked, suspended, or which has expired without renewal\nmay request, and the board may grant, a waiver of the requirement of possession of\na current apprentice license.\n(5) Every application for a license issued by the board shall be submitted on forms\nprepared by the board. Each applicant shall furnish pertinent background data as\noutlined on those forms.\n(6) The board shall promulgate administrative regulations in accordance with KRS\nChapter 13A to establish an initial license fee and biennial re newal license fee. The\ninitial license fee shall not exceed one hundred fifty dollars ($150) and the biennial\nrenewal fee shall not exceed three hundred dollars ($300).\n(a) All licenses shall expire on the thirtieth day of June of each even year.\n(b) Each license shall be renewed on or before the expiration date.\n(c) In addition to the renewal fee, a late fee shall be established by administrative\nregulations promulgated by t he board on each license renewed within six (6)\nmonths after the expiration date.\n(d) In the absence of any reason or condition which might warrant the refusal of\nrenewing a license, and upon timely receipt of the renewal form and the\nbiennial fee, the boa rd shall issue a license for the remainder of the ensuing\nbiennial license period.\n(7) (a) The board may require as a condition precedent to the renewal of any license,\nthat each licensee complete continuing education up to ten (10) hours per\nlicense year.  The board may impose different continuing education\nrequirements upon different classifications of licenses under this chapter. The\ncontinuing education requirements in this subsection shall not apply to those\nauctioneers licensed prior to January 1, 1980.\n(b) A licensee who has not completed the required continuing education may,\nwithin the time period set forth in subsections (6) and (12) of this section,\nremit a fee established by administrative regulations promulgated by the board\nwith the applicable r enewal fees, and the continuing education reporting\nrequirement shall be deferred to the next biennial renewal. If the licensee fails\nto meet the continuing education requirement for the next biennial renewal,\nthe licensee shall successfully complete the examination before renewal of his\nor her license.\n(c) 1. The board may require all licensees to complete a six (6) hour board -\napproved core course once every four (4) years, that includes the core\nsubjects of Kentucky auction statutes and regulations, ethic s, and any\nother subject matter deemed appropriate by the board.\n2. Effective July 1, 2016, each licensee with at least twenty -five (25) years\nof continuous licensure shall be exempt from the requirements of this\nparagraph.\n(8) (a) The board shall ensure t hat licensees may access a copy of their license\ncertificate via an electronic portal account.\n(b) Auction house operators shall display their licenses conspicuously and at all\ntimes in the auction house identified on the license.\n(c) All licensees shall c arry a copy of their license, or a digital facsimile thereof,\nwhen performing auctioneering tasks, to be shown upon request.\n(9) When an apprentice auctioneer is discharged or voluntarily terminates employment\nwith the auctioneer for any reason:\n(a) It sha ll be the immediate duty of the principal auctioneer to deliver to the\nboard a written release of the apprentice auctioneer; and\n(b) The apprentice auctioneer shall affiliate with a principal auctioneer within\nthirty (30) days by submitting to the board an  affiliation letter signed by the\nnew principal auctioneer and a fee established by administrative regulations\npromulgated by the board in accordance with KRS Chapter 13A.\nAn apprentice auctioneer shall not perform any of the acts regulated by this chapte r\nuntil receiving a new license bearing a new principal auctioneer's name and address.\n(10) (a) A licensee may place his or her license in escrow with the board if the\nlicensee does not engage in any board -regulated auctioneering activity and\ncontinues to pay the biennial renewal license fee.\n(b) For each year the license is in escrow, a licensee shall be exempt from the\ncontribution to the auctioneer's education, research, and recovery fund and the\ncontinuing education requirement.\n(c) To reactivate a lice nse in escrow, the licensee shall complete the core course\nand pay a reactivation fee and the biennial renewal recovery fee, both of\nwhich shall be established by administrative regulations promulgated by the\nboard in accordance with KRS Chapter 13A.\n(11) Notice in writing shall be given to the board by each licensee of any change of\nprincipal business location or residence address within ten (10) days of the change,\nand the board shall issue an updated license for the unexpired period. The board\nmay fine, suspend, or revoke the license of a licensee who does not notify the board\nof a change of address within ten (10) days. Changing a business or a residence\naddress on its records shall entitle the board to collect a fee established by\nadministrative regulat ions promulgated by the board in accordance with KRS\nChapter 13A.\n(12) (a) A licensee who has initiated continuing education courses prior to the date\nestablished through an administrative regulation promulgated by the board in\naccordance with KRS Chapter 13A shall have five (5) days after the\nestablished date to complete them.\n(b) The board may not cancel a license for failure to complete continuing\neducation courses until ten (10) days after the date established by the board.","path":["KRS Chapter 330"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55515","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"cb6868406dc69d9f769671d06d02c59bfe6ee181fa6ec2001ee8f1b5664516e1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-330.060","next":"us-ky/krs-330.080"},"notice":"GroundRules: Original legal text.
