{"data":{"id":"us-ky/krs-330.120","jurisdiction":"us-ky","citation":"KRS 330.120","heading":"Investigation of complaint -- Conditions -- Authorized board actions for","body":"investigation -- Disposition hearing.\n(1) The board may upon its own motion, and shall upon the verified written complaint\nof any person, investigate the actions of any licensee or any person who assumes to\nact as a licensee if the complaint, or complaint together with other evidence\npresented in connection with it, presents a prima facie case of a violation of this\nchapter. If a prima facie case is not established or the  violation is deemed\ninconsequential, the board may immediately dismiss the complaint.\n(2) To investigate allegations of practices violating this chapter, the board may:\n(a) Issue subpoenas to compel attendance of witnesses and the production of\nbooks, papers, documents, or other evidence;\n(b) Administer oaths;\n(c) Review evidence;\n(d) Examine witnesses; and\n(e) Pay appropriate witness fees.\n(3) If, after an investigation that includes opportunity for the licensee to respond, the\nboard determines that a vio lation took place but was not of a serious nature, it may\nissue a written admonishment to the licensee. A copy of the admonishment shall be\nplaced in the file of the licensee. The licensee shall have the right to file a response\nto the admonishment within thirty (30) days of its receipt and to have the response\nplaced in the licensure file. The licensee may alternatively, within thirty (30) days of\nthe receipt, file a request for hearing with the board. Upon receipt of this request,\nthe board shall set asid e the written admonishment and set the matter for hearing\nunder the provisions of KRS Chapter 13B.","path":["KRS Chapter 330"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52551","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:22Z","sha256":"ce577f30c0eeb71fae7b7aaa17e491edd48fffda287a5e80775b7b90482f4ff8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-330.115","next":"us-ky/krs-330.130"},"notice":"GroundRules: Original legal text.
