{"data":{"id":"us-ky/krs-333.020","jurisdiction":"us-ky","citation":"KRS 333.020","heading":"Definitions for chapter.","body":"As used in this chapter unless the context clearly indicates otherwise, the following terms\nshall have the meanings set forth below:\n(1) \"Person\" means any individual, firm, partnership, association, corporation,\nmunicipality, political subdivision, or any  other entity whether organized for profit\nor not;\n(2) \"Cabinet\" means the Cabinet for Health and Family Services;\n(3) \"Medical laboratory\" means any institution, building, place, or any other facility in\nwhich operations and procedures for the microbiolog ical, serological, chemical,\nhematological, immunohematological, biophysical, cytological, pathological, or\nother methods of examination of tissues including blood, secretions, and excretions\nof the human body are performed to obtain information in diagnos ing, preventing,\nor treating disease, or in which the results of any examination, determination, or test\nare used as a basis for health advice. These activities include the diagnosis and\nidentification of disease by the examination of tissues removed by su rgery and also\nthe determination of cause of death by the examination of tissues removed at\nautopsy. The term \"clinical laboratory\" shall be deemed synonymous with the term\n\"medical laboratory,\" and includes laboratories operated and maintained exclusively\nfor teaching purposes;\n(4) \"Medical laboratory director\" means the individual who is responsible for the\nadministrative, scientific, and technical operation of the medical laboratory,\nincluding supervision of laboratory procedures, reporting of findings, and active\nparticipation to such extent as may be necessary to assure compliance with the law.\nHe shall be responsible for the proper performance of all work in the laboratory and\nshall direct, supervise, and be responsible for the work of subordinates;\n(5) \"Medical laboratory supervisor\" means an individual who, under the general\nsupervision of a medical laboratory director, supervises technical personnel,\nperforms tests requiring special scientific skills, experience, and educational\nbackground, and, in t he absence of the director, is held responsible for the proper\nperformance of all medical laboratory procedures and the reporting of results;\n(6) \"Medical laboratory technologist\" means an individual who performs tests which\nrequire the exercise of indepen dent judgment and responsibility, with minimal\nsupervision by the director or supervisor, in only those specialties or subspecialties\nin which they are qualified by education, training, and experience;\n(7) \"Medical laboratory technician\" means any individu al other than the medical\nlaboratory director, supervisor, technologist, or trainee who functions under the\nsupervision of a medical laboratory director, supervisor, or technologist and\nperforms only those medical laboratory procedures which require limite d skill,\nresponsibility, and a minimal exercise of independent judgment;\n(8) \"Medical laboratory trainee\" means any individual in a medical laboratory who is\nseeking training and experience which, combined with the appropriate educational\nbackground, will qualify that person for employment as a \"medical technologist\" or\n\"medical laboratory technician.\" Trainees may perform procedures under the direct\nsupervision of the laboratory director, supervisor, or medical technologist;\n(9) \"Medical laboratory personnel\" includes the medical laboratory director, supervisor,\ntechnologist, or technician, but does not include medical laboratory assistants,\ntrainees, or other individuals employed by a medical laboratory to perform clerical\nor other administrative responsibilities;\n(10) \"Medical laboratory evaluation program\" means a program for evaluating the\nproficiency of medical laboratories by the cabinet; and\n(11) \"Medical laboratory advisory committee\" shall mean a group of consultants\nappointed by the secretary for h ealth and family services or his designee to advise\nthe cabinet on matters relating to the regulation of medical laboratories.","path":["KRS Chapter 333"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31841","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"b3512b6dafc13a71876e86700d04bf9ec77fb1a2464a5deefd29b66e9ef38170","source_id":"us-ky","stale":false,"prev":"us-ky/krs-333.010","next":"us-ky/krs-333.030"},"notice":"GroundRules: Original legal text.
