{"data":{"id":"us-ky/krs-333.090","jurisdiction":"us-ky","citation":"KRS 333.090","heading":"Qualifications of laboratory director -- Limit on tests.","body":"(1) Except as otherwise provided in subsections (2) and (3) of this section, the director\nof a medical laboratory shall be a physician licensed to practice medicine in\nKentucky.\n(2) The director of a medical laboratory may be the holder of an earned doctoral degree,\nwith a chemical, physical or biological science as his major subject, from an\ninstitution accredited by an appropriate agency of the state or by any other\nequivalent accrediting agency acceptable to the cabinet or from an institution which,\nin the o pinion of the cabinet, maintains standards equivalent to those of an\ninstitution accredited as aforesaid, who subsequent to graduation has had at least\ntwo (2) years of experience in the medical laboratory specialty for which he was\ntrained.\n(3) In the event an individual has been serving as a director of a medical laboratory in\nKentucky for a period of not less than a year prior to January 1, 1969, he may\ncontinue to direct such medical laboratory notwithstanding the requirement of\nsubsections (1) and (2) of this section, provided, however, that the cabinet may\nrequire (in the interest of the health, safety, and welfare of the people of this state)\nas a condition precedent to the issuance of an original or renewal license hereunder,\nthat such individuals de monstrate their ability satisfactorily to perform medical\nlaboratory examinations and to direct a medical laboratory.\n(4) Tests performed in a laboratory directed by a nonphysician shall be limited to the\nspecialties or subspecialties of medical laboratory procedures for which the director\nis personally qualified through education and experience and no medical\ninterpretation of test results, diagnosis, prognosis, or suggested treatment shall be\nmade.","path":["KRS Chapter 333"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31848","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"ed617e1df924d00235c4774049705499ed7d0cadab819c01d2e41f8c1607f65d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-333.080","next":"us-ky/krs-333.100"},"notice":"GroundRules: Original legal text.
