{"data":{"id":"us-ky/krs-333.150","jurisdiction":"us-ky","citation":"KRS 333.150","heading":"Human  specimens  to be examined  only on request of authorized","body":"persons  -- Transmission of medical laboratory results -- Compliance  with\nHIPAA  -- Contents of lab report.\n(1) A medical laboratory shall examine human  specimens only at the request of a\nlicensed physician, podiatrist, dentist, or other person authorized by law to use\nthe findings of medical laboratory examinations. The results of a test shall be\nreported to the licensed health care provider who requested it.\n(2) Medical laboratory results may be transmitted to:\n(a) Any health care provider who is treating the patient;\n(b) An electronic health information exchange or network for the purposes of\ntransmitting medical laboratory results to the ordering provider and to any\nother provider for the purposes of treatment, payment, or operations if\npatient consent has been obtained under the federal Health Insurance\nPortability and Accountability Act of 1996, Pub. L. No. 104-191; and\n(c) An  electronic health information exchange or network for the purpose of\nmeeting the requirements of the American Recovery and Reinvestment\nAct of 2009, Pub. L. No. 111-5, and its related federal regulations, and the\n21st Century Cures Act, Pub. L. No. 114-255, and its related federal\nregulations.\n(3) All transactions under subsection (2) of this section shall be in compliance with\nthe federal Health Insurance Portability and Accountability Act of 1996, Pub. L.\nNo. 104-191.\n(4) Laboratory reports shall include the name  of the director and the name  and\naddress of the medical laboratory in which the test was actually performed. All\nspecimens accepted by a medical laboratory shall be tested on the premises\nexcept that specimens for infrequently performed tests may be forwarded for\nexamination to another medical laboratory licensed under this chapter or to a\nmedical laboratory located outside this state if licensed or approved by the\nappropriate agency of the state concerned.","path":["KRS Chapter 333"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52179","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"baa07f3a5ca535cca0c688adbff09edffbf59ef817e91441db221a41dcf31b0a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-333.140","next":"us-ky/krs-333.152"},"notice":"GroundRules: Original legal text.
