{"data":{"id":"us-ky/krs-333.152","jurisdiction":"us-ky","citation":"KRS 333.152","heading":"Laboratory tests -- Disclosure -- Exceptions.","body":"(1) Notwithstanding any other provision of law to the contrary, except as provided\nby  subsection (2) of this section, a health care provider requesting that a\nmedical laboratory test for a patient is performed shall not engage  in\ninformation blocking as described in 42 U.S.C. sec. 300jj-52.\n(2) The following reports or test results and any other related results shall not be\ndisclosed to a patient as part of the patient\u0019s electronic health record, or in the\ncase  of a clinical laboratory test result, or pathology report, shall not be\ndisclosed by the person or entity that administers and controls the patient\u0019s\nelectronic health record, until seventy-two (72) hours after the results are\nfinalized, unless the health care provider directs the release of the results\nbefore the end of that seventy-two (72) hour period:\n(a) Pathology reports or radiology reports that have a reasonable likelihood\nof showing a finding of malignancy; or\n(b) Tests that could reveal genetic markers.","path":["KRS Chapter 333"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52178","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"169430681803e74a717a4c44ce42c17766d2135fa1b2b2953083a271ed3a6bb4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-333.150","next":"us-ky/krs-333.160"},"notice":"GroundRules: Original legal text.
