{"data":{"id":"us-ky/krs-333.200","jurisdiction":"us-ky","citation":"KRS 333.200","heading":"Hearing on revocation or suspension of license -- Effective date of final","body":"order -- Appeal.\n(1) In every proceeding for suspension or revocation of a license, the cabinet shall\nafford the medical laboratory director the opportunity for an administrativ e hearing\nto be conducted in accordance with KRS Chapter 13B. A license may be\ntemporarily suspended through the issuance of an emergency order pursuant to KRS\n13B.125 for a period not in excess of twenty (20) days upon notice to the medical\nlaboratory director following a finding by the cabinet that the public health, safety,\nor welfare is in imminent danger.\n(2) Except as otherwise provided in this subsection, every final order of the cabinet\nsuspending or revoking a license shall become effective thirty (30) days after notice\nis given to the medical laboratory director, unless the director within thirty (30) days\nfrom the giving of the notice, appeals therefrom in the manner provided by\nsubsection (3) of this section. Provided, however, that the cabinet m ay, when in its\nopinion the continued operation of the medical laboratory during the time allowed\nfor appeal would be dangerous to the health, welfare, and safety of the public,\nprovide in its final order of suspension or revocation that the order shall be come\neffective forthwith; and in this event the cabinet's order of suspension or revocation\nshall become effective as of the date specified therein, and the medical laboratory\nshall not, after notice of same, continue to operate under the license after rev ocation\nor during the period of suspension, unless and until the cabinet order is reversed or\nmodified by a final and unappealable order or judgment of a court made pursuant to\nthe provisions of subsection (3) of this section.\n(3) Any medical laboratory which is aggrieved by a final order of the cabinet placing it\non probation, or suspending or revoking its license may procure judicial review by\nfiling a petition in the Circuit Court of Franklin County, Kentucky, in accordance\nwith KRS Chapter 13B.","path":["KRS Chapter 333"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31859","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"c0329cc0d855877f2dd3f42755484928c9d4b8b23751c2bfbfeda0920514bbae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-333.190","next":"us-ky/krs-333.210"},"notice":"GroundRules: Original legal text.
