{"data":{"id":"us-ky/krs-334.010","jurisdiction":"us-ky","citation":"KRS 334.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Apprentice\" means any applicant in training to become a licensed specialist in\nhearing instruments;\n(2) \"Apprentice permit\" means a permit issued while the applicant is in training to\nbecome a licensed specialist in hearing instruments;\n(3) \"Board\" means the Kentucky Licensing Board for Specialists in Hearing\nInstruments;\n(4) \"Client\" means the user or purchaser of the hearing instrument;\n(5) \"License\" means a license issued by the board u nder this chapter to specialists in\nhearing instruments;\n(6) \"Over-the-counter hearing aid\" means air conduction hearing aids that satisfy the\nrequirements in the Over -the-Counter Hearing Aid Controls, 21 C.F.R. sec.\n800.30(c) to (f), and are considered available over the counter pursuant to 21 U.S.C.\nsec. 360j(q)(1)(A)(v), but do not satisfy the regulatory requirements for prescription\nhearing aids;\n(7) \"Practice of fitting hearing instruments\" means the measurement of human hearing\nby means of an audiomet er for the purpose of making selections, adaptions, and\nadjustments of hearing instruments, including both over -the-counter hearing aids\nand prescription hearing aids. The practice of fitting hearing instruments also\nincludes the making of ear mold impressions and custom earmolds and ordering the\nuse of hearing instruments;\n(8) \"Practice of selling and fitting hearing instruments\" means selling, ordering the use\nof, and fitting prescription hearing aids and over-the-counter hearing aids, including\nthe measurement of human hearing by means of an audiometer for the purpose of\nmaking selections, adaptions, and adjustments of hearing instruments. The practice\nof selling and fitting hearing instruments also includes the making of ear mold\nimpressions and custom earmolds and ordering the use of hearing instruments;\n(9) \"Prescription hearing aid\" means a Class 1 or Class 2 device as defined in the\nfederal Food, Drug and Cosmetic Act, 21 U.S.C. sec. 321(h), that is not an over -\nthe-counter hearing aid as defined in Ov er-the-Counter Hearing Aid Controls, 21\nC.F.R. sec. 800.30, or a hearing aid that does not satisfy the regulatory requirements\nfor over-the-counter hearing aids;\n(10) \"Sell\" or \"sale\" means any transfer of title or transfer of the right to use by lease,\nbailment, or any other means;\n(11) \"Specialist in hearing instruments\" means any individual licensed under this\nchapter;\n(12) \"Sponsor\" means a licensed specialist in he aring instruments qualified under KRS\n334.090(8) who assumes professional responsibility for an apprentice; and\n(13) \"Used\" or \"not new,\" with respect to a hearing instrument, means a hearing\ninstrument that has been the subject of a sale and the title to which was held by the\nclient for a period longer than thirty (30) days.","path":["KRS Chapter 334"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53760","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"eb53ce23e798e1cd1d2ee25dbae046e80c63c48873a3e30c480fd5b481adaeb5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-333.990","next":"us-ky/krs-334.020"},"notice":"GroundRules: Original legal text.
