{"data":{"id":"us-ky/krs-334.120","jurisdiction":"us-ky","citation":"KRS 334.120","heading":"Complaints  -- Procedure  -- Disciplinary sanctions -- Prohibited","body":"conduct.\n(1) Complaints against licensed persons shall be handled by the board in the\nfollowing manner:\n(a) Any  person desiring to make  a complaint against a licensee under this\nchapter shall reduce the complaint to writing and file it with the board.\n(b) The  board may  conduct an investigation into any complaint which the\nboard feels may constitute a violation of this chapter or the administrative\nregulations promulgated thereunder.\n(c) The  board may  require that the licensee file a statement or report in\nwriting as to the facts and circumstances concerning the complaint\ntogether with other information, material, or data reasonably related\nthereto.\n(d) The  board may  request the assistance of the Attorney General in\nconnection with an investigation.\n(e) The  board may  employ the services of a hearing officer to conduct\nhearings, prehearing conferences, advise the board as to legal matters,\nand provide other legal services deemed appropriate by the board.\n(2) If the board determines the charges made  in the complaint are sufficient to\nwarrant a hearing to determine whether the license issued under this chapter\nshall be suspended, revoked, or subject to reprimand or fine, it shall conduct a\nhearing in accordance with KRS Chapter 13B.\n(3) The provisions of this chapter shall in no way limit the jurisdiction and authority\nof the Attorney General to take any necessary action under the Kentucky\nConsumer  Protection Act, KRS 367.110 to 367.300.\n(4) The  board may suspend, revoke, or levy a fine not to exceed one thousand\ndollars ($1,000), refuse to issue or renew any license for a fixed period of time,\nplace on probation, issue a written reprimand to a licensee, or any combination\nthereof, based on a finding of the board after hearing that a person licensed\nunder the provisions of this chapter has committed any of the following acts:\n(a) Change  of personal name, corporate name, charter, entity, or partnership\nname  or composition to avoid the imposition of liens or court action;\n(b) The conviction of a felony, or a misdemeanor, if in accordance with KRS\nChapter 335B. The record of conviction, or a copy thereof, certified by the\nclerk of the court or by the judge in whose court the conviction is had,\nshall be conclusive evidence of that conviction;\n(c) Procuring of license by fraud or deceit practiced upon the board;\n(d) Unethical conduct as defined by the board by promulgation of an\nadministrative regulation;\n(e) Engaging in any unfair, false, misleading, or deceptive act or practice;\n(f) Incompetence or negligence in the practice of selling or fitting hearing\ninstruments; or\n(g) Violating any provision of this chapter or the administrative regulations\npromulgated thereunder.","path":["KRS Chapter 334"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46836","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"0101e8552f72adbde728ee41d135f17c814056f8a4f2d81b6b3d09f206e27ab6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-334.110","next":"us-ky/krs-334.130"},"notice":"GroundRules: Original legal text.
