{"data":{"id":"us-ky/krs-334a.122","jurisdiction":"us-ky","citation":"KRS 334A.122","heading":"Immunity from civil or criminal liability -- Actions to restrain or enjoin","body":"violations of chapter -- Representation of board by state and local prosecutors.\n(1) Members of the board and its agents and employees shall be immune from personal\nliability in any action, civil or criminal, which is based on any official act or acts\nperformed in good faith.\n(2) Notwithstanding any other civil or criminal remedy, the board may institute and\nmaintain actions to restrain or enjoin any violation of this chapter, related\nadministrative regulations promulgated by the board pursuant to KRS Chapter 13A,\nor order of the board.\n(3) The surrender of a license shall not serve to deprive the board of jurisdiction to\nproceed with disciplinary action pursuant to this chapter.\n(4) The city, county, or Commonwealth's attorney and the Attorney General shall,\nwithin their jurisdictions and within their legal discretion, represent the board and\nits agents and employees in the enforcement of the provisions of this chapter and\nrelated administrative regulations.","path":["KRS Chapter 334A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31904","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"45b0bd8cd2285c5ba2a2d88140bae9aad4987e10ce3417aebc319602e7600861","source_id":"us-ky","stale":false,"prev":"us-ky/krs-334a.120","next":"us-ky/krs-334a.130"},"notice":"GroundRules: Original legal text.
