{"data":{"id":"us-ky/krs-334a.175","jurisdiction":"us-ky","citation":"KRS 334A.175","heading":"Complaints -- Procedure -- Disciplinary sanctions -- Prohibited conduct.","body":"(1) (a) Any person who desires to make a complaint against a licensee under this\nchapter shall file a written complaint with the board.\n(b) The board may conduct an investigation into any complaint which it feels may\nconstitute a violation of this chapter or the administrative regulations it\npromulgates.\n(c) The board may require that the licensee file a written statement or report\nregarding the facts and circumstances c oncerning the complaint along with\nother information, material, or data reasonably related to it.\n(d) The board may request the assistance of the Attorney General in connection\nwith an investigation.\n(e) The board may employ the services of a hearing officer to:\n1. Conduct hearings and prehearing conferences;\n2. Advise the board as to legal matters; and\n3. Provide other legal services deemed appropriate by the board.\n(2) If the board determines the charges made in the complaint are sufficient to warrant a\nhearing to determine whether the license issued under this chapter shall be\nsuspended, revoked, or subject to reprimand or fine, it shall conduct a hearing in\naccordance with KRS Chapter 13B.\n(3) The provisions of this chapter shall in no way limit the juri sdiction and authority of\nthe Attorney General to take any necessary action under the Kentucky Consumer\nProtection Act, KRS 367.110 to 367.300.\n(4) The board may suspend, revoke, refuse to issue or renew any license for a fixed\nperiod of time, place on pro bation, issue a written reprimand to a licensee, levy a\nfine not to exceed one thousand dollars ($1,000), or any combination thereof, based\non a finding of the board that a person licensed under this chapter has committed\nany of the following acts:\n(a) Change of personal name, corporate name, charter, entity, or partnership name\nor composition to avoid the imposition of liens or court action;\n(b) The conviction of a felony or misdemeanor, if in accordance with KRS\nChapter 335B, including KRS 335B.020. Th e record of conviction, or a copy\nthereof, certified by the clerk of the court or by the judge in whose court the\nconviction is had, shall be conclusive evidence of that conviction;\n(c) Procuring of a license by fraud or deceit practiced upon the board;\n(d) Unethical conduct as defined by the board by promulgation of an\nadministrative regulation;\n(e) Engaging in any unfair, false, misleading, or deceptive act or practice;\n(f) Incompetence or negligence in the practice of selling or fitting hearing\ninstruments; or\n(g) Violating any provision of this chapter or administrative regulation\npromulgated by the board.","path":["KRS Chapter 334A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52584","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"deeab28cfea26220cffd80e2830284002cc5c3a317e932477244aff690786c10","source_id":"us-ky","stale":false,"prev":"us-ky/krs-334a.170","next":"us-ky/krs-334a.180"},"notice":"GroundRules: Original legal text.
