{"data":{"id":"us-ky/krs-334a.180","jurisdiction":"us-ky","citation":"KRS 334A.180","heading":"Licenses, causes for revocation, suspension or denial.","body":"(1) The board may refuse to issue a license, suspend or revoke the license of any\nlicensee, or fine a licensee an amount agreed upon by a two-thirds (2/3) vote of\nthe board in an amount not to exceed one thousand dollars ($1,000), and the\nboard may take action against a license and fine a licensee if he or she has\nbeen  guilty of unprofessional conduct which has endangered or is likely to\nendanger  the health, welfare, or safety of the public. Such unprofessional\nconduct may include:\n(a) Obtained  the license by  means  of fraud, misrepresentation, or\nconcealment of material facts;\n(b) Has  been  guilty of unprofessional conduct as defined by the rules\nestablished by the board, or has violated the code of ethics adopted and\npublished by the board;\n(c) Has  violated any lawful order, rule, or regulation rendered or adopted by\nthe board;\n(d) Has  represented that the professional services or advice of a physician\nhas been used, or has used the words \"doctor,\" \"clinic,\" or similar words,\nabbreviations, or symbols while failing to affix the word, term, or initials\npertaining to \"audiology,\" \"audiologic,\" \"audiologist,\" \"doctor of audiology,\"\n\"speech-language pathologist,\" \"speech-language pathology,\" \"Au.D.,\"\n\"Ph.D.,\" or \"Sc.D.\";\n(e) Has  failed to affix the word, term, or initials specified in paragraph (d) of\nthis subsection in any sign, written communication, or advertising media\nin which the term \"doctor\" or the abbreviation \"Dr.\" is used in relation to\nthe audiologist or speech-language pathologist holding a doctoral degree;\nor\n(f) Has violated any provisions of this chapter.\n(2) The  board shall deny an application for, or suspend or revoke, or impose\nprobationary conditions upon, a license as ordered by the board in any\ndecision made after hearing as provided in this chapter. One (1) year from the\ndate of revocation of a license under this chapter, application may be made to\nthe board for reinstatement. The board shall have discretion to accept or reject\nan application for reinstatement.\n(3) A  person applying for reinstatement of licensure shall provide evidence of\ncompletion of continuing professional education in speech-language pathology\nor audiology as prescribed by the board.\n(4) A  plea or verdict of guilty or a conviction following a plea of nolo contendere\nmade  to a charge of a felony is deemed  to be a conviction within the meaning\nof this chapter. At the direction of the board, if in accordance with KRS  Chapter\n335B, the license shall be suspended or revoked, or shall decline to issue a\nlicense when the time for appeal has elapsed, or the judgment of conviction\nhas been affirmed on appeal, or when an order granting probation is made\nsuspending the imposition of sentence irrespective of a subsequent order\nunder the provisions of the penal code allowing such person to withdraw his\nplea of guilty and to enter a plea of not guilty, or setting aside the verdict of\nguilty, or dismissing the acquisition, information or indictment.","path":["KRS Chapter 334A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46837","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:23Z","sha256":"e3b4fdc4f4dad53ae823f33e3d938590186bdad099210439b3d85c414953fdfb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-334a.175","next":"us-ky/krs-334a.181"},"notice":"GroundRules: Original legal text.
