{"data":{"id":"us-ky/krs-335.348","jurisdiction":"us-ky","citation":"KRS 335.348","heading":"Grounds  for disciplinary action -- Investigation -- Hearing.","body":"(1) The  board may refuse to issue a license or permit, or may suspend, revoke,\nimpose  probationary conditions upon, impose an administrative fine, issue a\nwritten reprimand or admonishment, or any combination thereof regarding any\nlicensee or permit holder upon proof that the licensee or permit holder has:\n(a) Committed any act of dishonesty or corruption, if in accordance with KRS\nChapter 335B. If the act constitutes a crime, conviction in a criminal\nproceeding is not a condition precedent to disciplinary action. Upon\nconviction of the crime, the judgment and sentence are presumptive\nevidence at the ensuing disciplinary hearing of the guilt of the licensee or\napplicant. Conviction includes all instances in which a plea of no contest\nis the basis of the conviction;\n(b) Misrepresented or concealed a material fact in obtaining a license, or in\nreinstatement thereof;\n(c) Committed any unfair, false, misleading, or deceptive act or practice;\n(d) Been  incompetent or negligent in the practice of marriage and family\ntherapy;\n(e) Violated any state statute or administrative regulation governing the\npractice of marriage and family therapy or any activities undertaken by a\nmarriage and family therapist;\n(f) Failed to comply with an order issued by the board or an assurance of\nvoluntary compliance;\n(g) Violated the code of ethics as set forth by the board in administrative\nregulations; or\n(h) Violated any applicable provision of any federal or state law, if in\naccordance with KRS Chapter 335B.\n(2) Five (5) years from the date of a revocation, any person whose license or\npermit has been revoked may petition the board for reinstatement. The board\nshall investigate the petition and may reinstate the license or permit upon a\nfinding that the individual has complied with any terms prescribed by the board\nand is again able to competently engage in the practice of marriage and family\ntherapy.\n(3) If, after an investigation that includes opportunity for the licensee to respond,\nthe board determines that a violation took place but was not of a serious\nnature, it may  issue a written admonishment to the licensee. A copy of the\nadmonishment  shall be placed in the permanent file of the licensee. The\nlicensee shall have the right to file a response to the admonishment  within\nthirty (30) days of its receipt and to have the response placed in the permanent\nlicensure file. The licensee may  alternatively, within thirty (30) days of the\nreceipt, file a request for hearing with the board. Upon receipt of this request,\nthe board shall set aside the written admonishment  and set the matter for\nhearing under the provisions of KRS Chapter 13B.\n(4) At any time during the investigative or hearing processes, the board may enter\ninto an agreed order or accept an assurance of voluntary compliance with the\nlicensee which effectively deals with the complaint.\n(5) The  board may reconsider, modify, or reverse its probation, suspensions, or\nother disciplinary actions.\n(6) The  surrender of a license or permit shall not serve to deprive the board of\njurisdiction to proceed with disciplinary actions pursuant to this chapter.","path":["KRS Chapter 335"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46839","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:24Z","sha256":"d09845c10715087f7f1d25d035307f46455d87ff3cecf3595f29195db543b886","source_id":"us-ky","stale":false,"prev":"us-ky/krs-335.342","next":"us-ky/krs-335.350"},"notice":"GroundRules: Original legal text.
