{"data":{"id":"us-ky/krs-335.540","jurisdiction":"us-ky","citation":"KRS 335.540","heading":"Standards of conduct -- Disciplinary sanctions -- Reinstatement.","body":"(1) The board may refuse to issue a credential, or may suspend, revoke, impose\nprobationary conditions upon, impose an administrative fine, or issue a written\nreprimand or admonishment if the credential holder has:\n(a) Committed a dishonest or corrupt act, if in accordance with KRS  Chapter\n335B. If the act is a crime, conviction in a criminal proceeding shall not be\na condition precedent to disciplinary action. Upon conviction of the crime,\nthe judgment and sentence are presumptive evidence at the ensuing\ndisciplinary hearing of the guilt of the credential holder or applicant.\nConviction includes all instances in which a plea of no contest is the basis\nof the conviction;\n(b) Misrepresented or concealed a material fact in obtaining or reinstating a\ncredential;\n(c) Committed any unfair, false, misleading, or deceptive act or practice;\n(d) Been  incompetent or negligent in the activities he has undertaken within\nhis or her practice;\n(e) Violated any  state statute or administrative regulation promulgated\npursuant to KRS 335.500 to 335.599;\n(f) Failed to comply with an order issued by the board or an assurance of\nvoluntary compliance;\n(g) Violated the code of ethics; or\n(h) Violated any applicable provisions of federal or state law, if in accordance\nwith KRS Chapter 335B.\n(2) Any  person whose credential has been revoked for at least five (5) or more\nyears may petition the board for reinstatement. The board shall investigate the\npetition and may reinstate the credential upon a finding that the individual has\ncomplied with the terms prescribed by the board and is able to competently\nengage in professional practice.\n(3) The  board may issue a written admonishment to the credential holder if the\nboard determines based on the evidence, that a violation that is not serious\nhas  occurred. A copy of the written admonishment  shall be placed in the\npermanent file of the credential holder. The credential holder may respond in\nwriting to the admonishment within thirty (30) days of its receipt and may have\nit placed in his permanent credential file. Alternatively, the credential holder\nmay  file a request for a hearing with the board within thirty (30) days of the\nadmonishment.  Upon  receipt of this request, the board shall set aside the\nwritten admonishment and set the matter for hearing pursuant to the provisions\nof KRS Chapter 13B.\n(4) At any time during the investigative or hearing processes, the board may enter\ninto an agreed order or accept an assurance of voluntary compliance with the\ncredential holder.\n(5) The  board may  consider, modify, or reverse its probation, suspensions, or\nother disciplinary action.","path":["KRS Chapter 335"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46840","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:24Z","sha256":"de113c21dc98b6cb4e85935c26fe9a5c41b62d8108849669bc74f10d4b6e4926","source_id":"us-ky","stale":false,"prev":"us-ky/krs-335.535","next":"us-ky/krs-335.545"},"notice":"GroundRules: Original legal text.
